<html:p>Existing law requires the Office of the State Fire Marshal to adopt hazardous liquid pipeline safety regulations that comply with federal law regarding hazardous liquid pipeline safety. Existing law establishes certain recordkeeping and reporting requirements for hazardous liquid pipeline operators.</html:p>
<html:p>This bill would require the office to require that dedicated hydrogen pipelines, as defined, meet specified requirements. The bill would require the office to establish, on or before January 1, 2028, and enforce standards that meet or exceed those requirements, as provided.</html:p>
<html:p>The bill would require a dedicated hydrogen pipeline owner to maintain accurate operational records of hydrogen concentration levels within its dedicated hydrogen pipeline and any confirmed instances of leakage of hydrogen and, on or
before March 30 of each year, to submit a report to the office detailing compliance with that requirement for the previous calendar year.</html:p>
<html:p>The bill would provide that its provisions do not limit the authority of the Public Utilities Commission to regulate the rates, services, or safety practices of public utilities, and clarify that, if there is a conflict between a provision of the bill and a provision adopted by the commission, the more protective provision applies.</html:p>

Ensuring the safety and environmental integrity of dedicated hydrogen pipelines is crucial for the protection of California’s residents, physical property, and natural environment.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
Hydrogen has the potential to significantly reduce our carbon footprint and serve as a cornerstone for a sustainable and clean energy future.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
Proactive state leadership is required to set comprehensive and effective standards in the absence of sufficient federal regulations.
</html:p>

<html:p>This chapter shall be known, and may be cited, as the Hydrogen Pipeline Safety Act.</html:p>

<html:p>For purposes of this chapter, all of the following definitions apply:</html:p>
<html:p>
(a)
<html:span class="EnSpace"/>
“Continuous measurement and monitoring system” means a set of integrated tools and technologies designed to continuously assess the operational status of a dedicated hydrogen pipeline that is capable of detecting leaks, enables prompt automated or manual corrective actions to prevent a hydrogen release into the atmosphere, and supports pipeline safety and efficiency.

<html:span class="EnSpace"/>
“Dedicated hydrogen pipeline” means a dedicated pipeline that has been constructed, or has undergone a major retrofit, on or after the effective date of the
dedicated hydrogen pipeline safety standards established by the Office of the State Fire Marshal pursuant to this chapter, for the purpose of transporting hydrogen gas.
</html:p>

(2)
<html:span class="EnSpace"/>
The Office of the State Fire Marshal shall adopt a percentage of hydrogen gas by volume carried in a pipeline for the purpose of identifying those pipelines that meet this chapter’s definition of a “dedicated hydrogen pipeline.” A percentage adopted by the Office of the State Fire Marshal for this purpose shall exceed
90 percent.

(c)
<html:span class="EnSpace"/>
“Major retrofit” means a substantial modification made to a pipeline or pipeline infrastructure that improves or repurposes it for use as a dedicated hydrogen pipeline.

(a)
<html:span class="EnSpace"/>
The Office of the State Fire Marshal shall require that dedicated hydrogen pipelines meet all of the following requirements:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
A dedicated hydrogen pipeline shall be designed and constructed to minimize hydrogen leakage to the lowest technically feasible level, as determined by the Office of the State Fire Marshal.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
All materials used in the construction of a dedicated hydrogen pipeline shall be materials codified by the
American Society of Mechanical Engineers, or its equivalent, for compatibility with hydrogen and resistance to hydrogen-induced degradation such as corrosion or embrittlement.

<html:span class="EnSpace"/>
A dedicated hydrogen pipeline shall employ continuous
measurement and monitoring systems to detect deviations from normal operational parameters.
</html:p>

<html:span class="EnSpace"/>

<html:span class="EnSpace"/>
On or before January 1, 2028, the Office of the State Fire Marshal shall establish dedicated hydrogen pipeline safety standards that meet or exceed the requirements of subdivision (a).
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
The Office of the State Fire Marshal shall assure alignment of standards, and periodically review and update the dedicated hydrogen pipeline safety standards, incorporating technological advancements and industry best practices.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
The Office of the State Fire Marshal shall enforce the hydrogen pipeline safety standards consistently across all jurisdictions within the
state.

The owner of a dedicated hydrogen pipeline shall maintain accurate operational records of hydrogen concentration levels within the dedicated hydrogen pipeline and any confirmed instances of leakages of hydrogen.

<html:p>
(b)
<html:span class="EnSpace"/>
On or before March 30 of each year, the owner of a dedicated hydrogen pipeline shall submit a report to the Office of the State Fire Marshal detailing its compliance with subdivision (a) for the previous calendar year.

<html:p>This chapter does not limit the authority of the Public Utilities Commission to regulate the rates, services, or safety practices of a public utility subject to its jurisdiction pursuant to Section 216 of the Public Utilities Code. If there is a conflict between a provision of this chapter and a provision adopted by the commission, the more protective provision shall apply.</html:p>
