			<html:p>Under existing law, the State Water Resources Control Board and the 9 California regional water quality control boards regulate water quality and prescribe waste discharge requirements in accordance with the Porter-Cologne Water Quality Control Act and the federal national pollutant discharge elimination system permit program established by the federal Clean Water Act. </html:p>
			<html:p>The California Integrated Waste Management Act of 1989 prohibits a regional board from issuing a waste discharge permit for a new landfill, or a lateral expansion of an existing landfill, that is used for the disposal of nonhazardous solid waste if the land has been primarily used at any time for the mining or excavation of gravel or sand, except as specified.</html:p>
			<html:p>This bill would prohibit a state agency from issuing a
			 waste discharge permit for a new Class III landfill, as defined, unless certain conditions are met, including, but not limited to, the county board of supervisors for the county in which the proposed project resides has held a separate publicly noticed hearing to consider whether the proposed landfill is consistent with the goals, policies, and objectives of the environmental justice element of the county’s general plan. To the extent that the bill would require counties to perform additional duties related to application for a new Class III landfill, this bill would impose a state-mandated local program.</html:p>
			<html:p>The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.</html:p>
			<html:p>This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.</html:p>

								(a)
								<html:span class="EnSpace"/>
								For purposes of this section, the following definitions apply:
							</html:p>
							<html:p>
								(1)
								<html:span class="EnSpace"/>
								“CalEnviroScreen” means the California Communities Environmental Health Screening, also known as CalEnviroScreen, that is used to identify disadvantaged communities pursuant to Section 39711 of the Health and Safety Code.
							</html:p>
							<html:p>
								(2)
								<html:span class="EnSpace"/>
								“Environmental
						justice community” means an area with a Pollution Burden score in the 90th percentile, as defined by
						CalEnviroScreen.
							</html:p>
							<html:p>
								(3)
								<html:span class="EnSpace"/>
								“New Class III landfill” means a Class III landfill, as that term is used in Subchapter 2 (commencing with Section 20200) of Chapter 3 of Subdivision 1 of Division 2 of Title 27 of the California Code of Regulations, that has not previously been issued a waste discharge permit or previously received waste on or before January 1, 2026.

								(b)
								<html:span class="EnSpace"/>
								A state agency shall not issue a waste discharge permit for a new Class III landfill
						unless all of the following conditions have been met:
							</html:p>
							<html:p>
								(1)
								<html:span class="EnSpace"/>
								The county board of supervisors for the county in which the proposed project resides has held a separate publicly noticed hearing to consider whether the proposed landfill is consistent with the goals, policies, and objectives of the environmental justice element adopted by the county pursuant to subdivision (h) of Section 65302 of the Government Code.

								(2)
								<html:span class="EnSpace"/>
								The county board of supervisors shall include in the hearing record a summary of its evaluation described in paragraph (1), including, but not limited to, any identified conflicts between the proposed project and the environmental justice element adopted by the county.
							</html:p>

								(3)
								<html:span class="EnSpace"/>
								The county
						board of supervisors shall submit the summary described in paragraph (2), and all public comments received at the hearing, to the relevant regional water board as part of the permit application review.
							</html:p>
							<html:p>
								(4)
								<html:span class="EnSpace"/>
								If the jurisdiction has not adopted an environmental justice element pursuant to subdivision (h) of Section 65302 of the Government Code, the local enforcement agency shall consider available environmental justice indicators, including CalEnviroScreen data and other relevant community health metrics, when evaluating potential disproportionate impacts on environmental justice communities.
