			<html:p>Existing law vests the Department of Transportation with full possession and control of the state highway system, including associated property, and authorizes the department to require the removal of any encroachment in, under, or over any state highway. Existing law authorizes the department to establish maintenance programs related to highway cleanup, as specified.</html:p>
			<html:p>This bill would require the department to establish a dedicated liaison to, among other things, facilitate communication with local governments and relevant state agencies with regard to addressing homeless encampments within the state highway system and to oversee the development and implementation of delegated maintenance agreements between
			 local agencies and the department in which both work together to reduce and remove homeless encampments within the department’s jurisdiction. The bill would authorize the department to grant a single general entry permit for the duration of a delegated maintenance agreement to conduct activities authorized by the bill. The bill would require the department to submit an annual report to the Legislature summarizing specified information and recommendations regarding homeless encampments.</html:p>

		<ns0:Preamble>The people of the State of California do enact as follows:</ns0:Preamble>

				<html:p>This act shall be known, and may be cited, as the California Homeless Encampment Collaboration Act.</html:p>

			<ns0:Content>
				<html:p>The Legislature finds and declares all of the following:</html:p>
				<html:p>
					(a)
					<html:span class="EnSpace"/>
					Homelessness is a significant and growing issue across the state, impacting public safety, health, and the environment.
				</html:p>
				<html:p>
					(b)
					<html:span class="EnSpace"/>
					Many homeless encampments are located on property owned or managed by the Department of Transportation.
				</html:p>
				<html:p>
					(c)
					<html:span class="EnSpace"/>
					Addressing homelessness on state property requires a collaborative effort between the Department of Transportation, local governments, and community organizations to ensure effective and humane solutions.
				</html:p>
			</ns0:Content>

								(a)
								<html:span class="EnSpace"/>
								For purposes of this section, the following definitions apply:
							</html:p>
							<html:p>
								(1)
								<html:span class="EnSpace"/>
								“Delegated maintenance agreement” means a contract entered into by the department and a local government pursuant to Section 130 in which both work together to reduce and remove homeless encampments within the department’s jurisdiction.
							</html:p>
							<html:p>
								(2)
								<html:span class="EnSpace"/>
								“Homeless encampment” means a temporary living area established by individuals experiencing homelessness on public property.
							</html:p>
							<html:p>
								(3)
								<html:span class="EnSpace"/>
								“Local government” means a city or county.
							</html:p>
							<html:p>
								(b)
								<html:span class="EnSpace"/>
								The department shall establish a dedicated liaison to do all of the
						following:
							</html:p>
							<html:p>
								(1)
								<html:span class="EnSpace"/>
								Facilitate communication with local governments and relevant state agencies with regard to addressing homeless encampments within the state highway system.
							</html:p>
							<html:p>
								(2)
								<html:span class="EnSpace"/>
								Provide guidance and support for implementing best practices with regard to addressing homeless encampments within the state highway system.
							</html:p>
							<html:p>
								(3)
								<html:span class="EnSpace"/>
								Oversee the development and implementation of delegated maintenance agreements.
							</html:p>
							<html:p>
								(4)
								<html:span class="EnSpace"/>
								Review existing practices and contracting to maximize efficient abatement and clearing of homeless encampments.
							</html:p>
							<html:p>
								(5)
								<html:span class="EnSpace"/>
								Create a publicly accessible digital collection of executed delegated maintenance agreements entered into by the department, which shall include, but not be limited to,
						information regarding the geographic location covered by each agreement, the amount of funding allocated for each agreement, and the activities conducted pursuant to each agreement.
							</html:p>
							<html:p>
								(6)
								<html:span class="EnSpace"/>
								Collaborate with local governments to develop timelines for the department’s response to requests from local governments for homeless encampment removal.
							</html:p>
							<html:p>
								(7)
								<html:span class="EnSpace"/>
								In collaborating with local governments to develop timelines pursuant to paragraph (6), consider prioritizing homeless encampments that pose environmental hazards, such as those that may lead to heightened fire risk.
							</html:p>
							<html:p>
								(c)
								<html:span class="EnSpace"/>
								The department, upon appropriation by the Legislature, may, but shall not be required to, provide reimbursement to local governments for services rendered pursuant to delegated maintenance agreements for addressing homeless encampments on department property.
						These services may include, but are not limited to, any of the following:
							</html:p>
							<html:p>
								(1)
								<html:span class="EnSpace"/>
								Outreach and support programs.
							</html:p>
							<html:p>
								(2)
								<html:span class="EnSpace"/>
								Environmental cleanup and restoration efforts.
							</html:p>
							<html:p>
								(3)
								<html:span class="EnSpace"/>
								Homeless encampment abatement.
							</html:p>
							<html:p>
								(4)
								<html:span class="EnSpace"/>
								Trash removal.
							</html:p>
							<html:p>
								(5)
								<html:span class="EnSpace"/>
								Graffiti abatement.
							</html:p>
							<html:p>
								(d)
								<html:span class="EnSpace"/>
								The department may execute a delegated maintenance agreement that allows a local agency to use its local homeless encampment abatement policies and personnel.
							</html:p>
							<html:p>
								(e)
								<html:span class="EnSpace"/>
								The department may grant a single general entry permit for the duration of a delegated maintenance agreement to conduct activities pursuant to this section.
							</html:p>
							<html:p>
								(f)
								<html:span class="EnSpace"/>
								Notwithstanding Section 10231.5 of the Government Code, the department shall submit an annual report to the Legislature summarizing both of the following:
							</html:p>
							<html:p>
								(1)
								<html:span class="EnSpace"/>
								The number of homeless encampments addressed through collaboration with local governments.
							</html:p>
							<html:p>
								(2)
								<html:span class="EnSpace"/>
								Recommendations for improving coordination and resource allocation with regard to addressing homeless encampments.
							</html:p>
