This subdivision shall be implemented only to the extent that it does not conflict with federal law. </html:p> <html:p> (b) <html:span class="EnSpace"/> For purposes of this section, “descendant of slavery” means an individual who can establish direct lineage to a person who, before 1900, was subjected to American chattel slavery and meets at least one of the following criteria: </html:p> <html:p> (1) <html:span class="EnSpace"/> Was emancipated through legal or extralegal means, including self-purchase, manumission, legislative action, military service, or judicial ruling. </html:p> <html:p> (2) <html:span class="EnSpace"/> Obtained freedom through gradual abolition statutes or constitutional amendments. </html:p> <html:p> (3) <html:span class="EnSpace"/> Was classified as a fugitive from bondage under federal or state law. </html:p> <html:p> (4) <html:span class="EnSpace"/> Was deemed contraband by military authorities. </html:p> <html:p> (5) <html:span class="EnSpace"/> Rendered military or civic service while subject to legal restrictions based on ancestry historically associated with slavery. </html:p> </ns0:Content> </ns0:LawSectionVersion> </ns0:LawSection> </ns0:LawHeading> </ns0:Fragment> </ns0:BillSection> </ns0:Bill> </ns0:MeasureDoc> |
