Existing law establishes uniform residency requirements for purposes of ascertaining the amount of tuition and fees to be paid by students of public postsecondary educational institutions. Existing law requires a student classified as a nonresident to pay nonresident tuition, in addition to other fees required by the institution, except as provided.</html:p> <html:p>This bill, the California Community Colleges Access and Continuity for Deported Students Act, would, until January 1, 2030, exempt a community college student from paying nonresident tuition if the student departs the United States on or after January 1, 2025, for specified reasons, was not paying nonresident tuition at the time of departure, provides an attestation of specified information related to the departure, and reenrolls in a community college online education program no later than 3 years from the date the student departed the United States. The bill, until January 1, 2030, would require a deported student, as defined, who resumes in-person education at a community college to be eligible to retain residency status for the purpose of determining tuition and fees, provided the student was previously classified as a resident and eligible for the nonresident tuition exemption at the time of departure, and would require the student to be eligible to apply for financial aid upon reenrollment. To the extent that the bill would impose new duties on community college districts, the bill would impose a state-mandated local program.</html:p> <html:p>The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Furthermore, this approach aligns with California’s commitment to education equity, innovation, and global leadership. </html:p> <html:p> (e) <html:span class="EnSpace"/> Some students may later return to the United States with legal immigration status, bringing valuable expertise and education to California’s workforce. </html:p> <html:p> (f) <html:span class="EnSpace"/> Educated alumni who remain connected to California institutions can foster international collaborations in business, research, and culture. </html:p> <html:p> (g) <html:span class="EnSpace"/> Helping these students succeed can contribute to global development, reducing economic disparities and migration pressures. </html:p> </ns0:Content> </ns0:BillSection> <ns0:BillSection id="id_A6048C0A-FDAC-4352-BB39-F6316B6F1DC6"> <ns0:Num>SEC. 2.</ns0:Num> <ns0:ActionLine action="IS_ADDED" ns3:href="urn:caml:codes:EDC:caml#xpointer(%2Fcaml%3ALawDoc%2Fcaml%3ACode%2Fcaml%3ALawHeading%5B%40type%3D'TITLE'%20and%20caml%3ANum%3D'3.'%5D%2Fcaml%3ALawHeading%5B%40type%3D'DIVISION'%20and%20caml%3ANum%3D'7.'%5D%2Fcaml%3ALawHeading%5B%40type%3D'PART'%20and%20caml%3ANum%3D'47.'%5D%2Fcaml%3ALawHeading%5B%40type%3D'CHAPTER'%20and%20caml%3ANum%3D'1.'%5D%2Fcaml%3ALawHeading%5B%40type%3D'ARTICLE'%20and%20caml%3ANum%3D'10.'%5D)" ns3:label="fractionType: LAW_SPREAD||commencingWith: 76150" ns3:type="locator"> Article 10 (commencing with Section 76150) is added to Chapter 1 of Part 47 of Division 7 of Title 3 of the <ns0:DocName>Education Code</ns0:DocName> , to read: </ns0:ActionLine> <ns0:Fragment> <ns0:LawHeading id="id_1DBD0275-AB8B-4A95-A548-FAF4EC9B0449" type="ARTICLE"> <ns0:Num>10.</ns0:Num> <ns0:LawHeadingVersion id="id_A7B4A445-D1A4-48AB-B723-B9BA56D91B94"> <ns0:LawHeadingText>California Community Colleges Access and Continuity for Deported Students Act</ns0:LawHeadingText> </ns0:LawHeadingVersion> <ns0:LawSection id="id_03E9CC34-48F7-4496-92F2-560DAA180A26"> <ns0:Num>76150.</ns0:Num> <ns0:LawSectionVersion id="id_11DAD93D-6F21-42C0-8FAE-E9A20C0C56E2"> <ns0:Content> <html:p>This article shall be known, and may be cited, as the California Community Colleges Access and Continuity for Deported Students Act.</html:p> </ns0:Content> </ns0:LawSectionVersion> </ns0:LawSection> <ns0:LawSection id="id_D4BD3181-4756-420E-A803-9F496285E9C7"> <ns0:Num>76151.</ns0:Num> <ns0:LawSectionVersion id="id_D9E931DC-F563-456C-9743-C325B7D346C2"> <ns0:Content> <html:p>For purposes of this article, the following definitions shall apply:</html:p> <html:p> (a) <html:span class="EnSpace"/> “Deported student” means a student who departed the United States on or after January 1, 2025, was enrolled in a California community college at the time of departure or detention, and the departure occurred for any of the following reasons: </html:p> <html:p> (1) <html:span class="EnSpace"/> Due to immigration enforcement actions by the United States Department of Homeland Security. </html:p> <html:p> (2) <html:span class="EnSpace"/> Voluntarily due to the threat of immigration enforcement by the United States Department of Homeland Security. </html:p> <html:p> (3) <html:span class="EnSpace"/> Due to being denied reentry to the United States after voluntarily departing with the intention of making a brief trip abroad. </html:p> <html:p> (b) <html:span class="EnSpace"/> “Online education program” means a distance education program offered by a California community college, including, but not limited to, career development and college preparation courses offered pursuant to Section 84760.5, that allows students to complete coursework remotely. </html:p> </ns0:Content> </ns0:LawSectionVersion> </ns0:LawSection> <ns0:LawSection id="id_A89DE673-58D7-4327-AB60-75AF7DDF21A3"> <ns0:Num>76152.</ns0:Num> <ns0:LawSectionVersion id="id_C6678DE1-4C89-4475-AD35-F70EBB8981C9"> <ns0:Content> <html:p> (a) <html:span class="EnSpace"/> Notwithstanding any other law, a deported student shall be exempt from paying nonresident tuition under this article if the student meets all of the following requirements: </html:p> <html:p> (1) <html:span class="EnSpace"/> The student was enrolled in a California community college and not paying nonresident tuition at the time of departure. The California community college at which the student seeks to enroll shall verify that the student has met the requirements of this paragraph. </html:p> <html:p> (2) <html:span class="EnSpace"/> The student provides an attestation to all of the following: </html:p> <html:p> (A) <html:span class="EnSpace"/> The student no longer resides in the United States. </html:p> <html:p> (B) <html:span class="EnSpace"/> The date the student departed the United States. </html:p> <html:p> (C) <html:span class="EnSpace"/> The reason the student departed the United States, consistent with subdivision (a) of Section 76151. </html:p> <html:p> (D) <html:span class="EnSpace"/> The name of the California community college at which the student was enrolled before the student departed the United States. </html:p> <html:p> (3) <html:span class="EnSpace"/> The student reenrolls in an online education program offered by a California community college no later than three years from the date the student departed the United States. </html:p> <html:p> (b) <html:span class="EnSpace"/> A deported student that meets the requirements of subdivision (a) shall be exempt from nonresident tuition for the duration of the student’s enrollment in an online education program. </html:p> <html:p> (c) <html:span class="EnSpace"/> A deported student shall remain exempt from paying nonresident tuition until completion of any of the following: </html:p> <html:p> (1) <html:span class="EnSpace"/> An associate degree for transfer. </html:p> <html:p> (2) <html:span class="EnSpace"/> An associate of arts degree. </html:p> <html:p> (3) <html:span class="EnSpace"/> A certificate of completion. </html:p> <html:p> (4) <html:span class="EnSpace"/> A certificate of achievement. </html:p> <html:p> (5) <html:span class="EnSpace"/> A certificate of competency in a recognized career field by articulating with college-level coursework. </html:p> <html:p> (6) <html:span class="EnSpace"/> Courses required for transfer to a four-year degree program. </html:p> <html:p> (d) <html:span class="EnSpace"/> If and when a deported student resumes in-person education at a California community college, the student shall be eligible for all of the following: </html:p> <html:p> (1) <html:span class="EnSpace"/> Retaining residency status for the purpose of determining tuition and fees, provided the student was previously classified as a resident and met the requirements under subdivision (a) at the time of departure. </html:p> <html:p> (2) <html:span class="EnSpace"/> Being exempt from nonresident tuition, provided the student previously qualified for an exemption from nonresident tuition and met the requirements under subdivision (a) at the time of departure. </html:p> <html:p> (3) <html:span class="EnSpace"/> Applying for financial aid upon reenrollment. </html:p> </ns0:Content> </ns0:LawSectionVersion> </ns0:LawSection> <ns0:LawSection id="id_507444B5-D8CF-4B31-89F4-D51F659D1DB7"> <ns0:Num>76153.</ns0:Num> <ns0:LawSectionVersion id="id_B1870A25-66D9-405D-9C0B-D20B529D7F1E"> <ns0:Content> <html:p>This article shall remain in effect only until January 1, 2030, and as of that date is repealed.</html:p> </ns0:Content> </ns0:LawSectionVersion> </ns0:LawSection> </ns0:LawHeading> </ns0:Fragment> </ns0:BillSection> <ns0:BillSection id="id_65A367E2-63A4-4383-A8F3-B004F8DDF5D3"> <ns0:Num>SEC. 3.</ns0:Num> <ns0:Content> <html:p>If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.</html:p> </ns0:Content> </ns0:BillSection> <ns0:BillSection id="id_C7B3C819-E940-4288-B031-9850427D168A"> <ns0:Num>SEC. 4.</ns0:Num> <ns0:Content> <html:p>This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the California Constitution and shall go into immediate effect.
