                                                        <html:p>For purposes of this chapter, the following definitions apply:</html:p>
                                                        <html:p>
                                                                (a)
                                                                <html:span class="EnSpace"/>
                                                                “Social media video service” means an internet website that meets all of the following criteria:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                It is open to the public.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                It allows a user to create an account.
                                                        </html:p>
                                                        <html:p>
                                                                (3)
                                                                <html:span class="EnSpace"/>
                                                                It consists primarily of content that is user generated and not preselected by the provider.
                                                        </html:p>
                                                        <html:p>
                                                                (4)
                                                                <html:span class="EnSpace"/>
                                                                It provides a landing page, main feed, or search function that presents the user with video content generated by other users.
                                                        </html:p>
                                                        <html:p>
                                                                (b)
                                                                <html:span class="EnSpace"/>
                                                                “Video programming” has the same meaning as defined in Section 613(h) of Title 47 of the United States Code.
                                                        </html:p>
                                                        <html:p>
                                                                (c)
                                                                <html:span class="EnSpace"/>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                “Video streaming service” means an entity that makes available directly to the consumer, through a distribution method that uses internet protocol, either of the following:
                                                        </html:p>
                                                        <html:p>
                                                                (A)
                                                                <html:span class="EnSpace"/>
                                                                Video programming.
                                                        </html:p>
                                                        <html:p>
                                                                (B)
                                                                <html:span class="EnSpace"/>
                                                                Video content the entity makes available for users to view.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                “Video streaming service” does not include a television broadcast station, cable operator, or other multichannel video programing distributor, or an entity that serves video programming or video content without commercial
                                                advertisements.

                                                        <html:p>On and after July 1, 2026, a social media video service, music streaming service, podcast streaming service, or video streaming service that serves consumers residing in the state shall not transmit the audio of commercial advertisements louder than the content the advertisements accompany, consistent with the regulations adopted by the Federal Communications Commission pursuant to the Commercial Advertisement Loudness Mitigation (CALM) Act (Public Law 111-311) for television broadcast stations, cable operators, and other multichannel video programming distributors.</html:p>
