<html:p>The federal Child Citizenship Act of 2000 provides that a child born outside the United States shall automatically become a citizen of the United States when all of specified conditions have been fulfilled, including that at least one parent of the child is a citizen of the United States and the child is under 18 years of age. The federal act applies these provisions to an adopted child if the adopted child satisfies the applicable requirements under a specified provision of federal law. Existing state law generally provides for the adoption of a child native to a foreign country by a prospective adoptive parent or parents who are California residents that is either finalized in another country or this state.</html:p>
<html:p>This bill would declare the intent of the Legislature to enact legislation related to foreign-born child adoptees who are now adults and
would make related findings and declarations.</html:p>

<ns0:Preamble>The people of the State of California do enact as follows:</ns0:Preamble>

<ns0:Num>SECTION 1.</ns0:Num>

(a)

The Legislature finds and declares all of the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Tens of thousands of legal adoptees who were born before February 27, 1982, and raised in the United States are still undocumented and, therefore, potentially subject to deportation. These adoptees’ parents did not complete necessary processes to provide their adopted children with citizenship, or in many cases, even a green card.

Adoptees who do not have citizenship have come from countries all over the world, including Argentina, Brazil, Colombia, Costa Rica, El Salvador, Germany, Guatemala, Haiti, India, Iran, Ireland, Japan, Mexico, Panama, Philippines, Russia, Ukraine, and
Vietnam.

<html:span class="EnSpace"/>
There are an estimated 18,000 Korean American adoptees alone who do not have United States citizenship despite having been legally adopted.

<html:span class="EnSpace"/>
Therefore, it is the intent of the Legislature to enact legislation related to foreign-born adoptees who are now adults.
