                                Existing law, the Davis-Stirling Common Interest Development Act, governs the management and operation of common interest developments. Existing law places various limits and prohibitions on the governing documents, as defined, relative to an owner’s separate interest within those developments.
                        </html:p>
                        <html:p>This bill would prohibit those governing documents from limiting or prohibiting the owner of a separate interest within a common interest development from replacing existing residential windows with California Energy Code-compliant windows, as defined, or from imposing any requirements on California Energy Code-compliant windows in a housing development
                         project, as defined.</html:p>

                                <html:span class="EnSpace"/>
                                The Planning and Zoning Law authorizes the legislative body of any county or city to adopt ordinances that regulate the use of buildings, structures, and land as between industry, business, residences, open space, and other purposes.
                        </html:p>
                        <html:p>This bill would require a city, county, or city and county to administratively approve an application to replace existing residential windows with California Energy Code-compliant windows, as defined. The bill would prohibit a city, county, or city and county from requiring discretionary review or a hearing for a residential window replacement project that is subject to certain limitations. The bill would also prohibit a city, county, or city and county from denying an application for a permit to replace existing windows with California Energy Code-compliant windows
                         or from imposing any conditions on California Energy Code-compliant windows proposed in a housing development project, except as specified. The bill would limit the application of these provisions under certain circumstances, including if a residential structure is individually listed as a historical resource in the State Historic Resources Inventory, as defined.</html:p>
                        <html:p>By adding to the duties of local governments, this bill would impose a state-mandated local program.</html:p>
                        <html:p>The bill would include findings that changes proposed by this bill address a matter of statewide concern rather than a municipal affair and, therefore, apply to all cities, including charter cities.</html:p>

                                The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated
                         by the state. Statutory provisions establish procedures for making that reimbursement.
                        </html:p>
                        <html:p>This bill would provide that no reimbursement is required by this act for a specified reason.</html:p>

                                                                <html:span class="EnSpace"/>
                                                                For the purposes of this section, “California Energy Code-compliant windows” has the same meaning as defined in Section 65850.73 of the Government Code.
                                                        </html:p>
                                                        <html:p>
                                                                (b)
                                                                <html:span class="EnSpace"/>
                                                                No governing documents shall limit or prohibit the owner of a separate interest within a common interest development from replacing existing residential windows with California Energy Code-compliant windows or impose any requirements on California Energy Code-compliant windows in a housing development project.

                                                                As used in this section, “housing development project” means a housing development project as defined in paragraph (2) of subdivision (h) of Section 65589.5 of the Government Code.

                                                                (a)
                                                                <html:span class="EnSpace"/>
                                                                 The Legislature finds and declares that retrofitting windows in existing residential buildings with windows that meet current California Energy Code standards is critical to reducing energy consumption and achieving the state’s climate goals, which is a matter of statewide concern and is not a municipal affair as that term is used in Section 5 of Article XI of the California Constitution. Therefore, this section applies to all cities, including charter cities.
                                                        </html:p>
                                                        <html:p>
                                                                (b)
                                                                <html:span class="EnSpace"/>
                                                                For the purposes of this section, the following definitions apply:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                “California Energy Code-compliant
                                                windows” means windows that meet or exceed the mandatory requirements for
                                                fenestration products and exterior doors, as described in Section 110.6 of the California Energy Code (Part 6 of Title 24 of the California Code of Regulations) or a subsequent code section adopted by the California Building Standards Commission in the most recent triennial building code cycle.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                “Housing development project” means a housing development project as defined in paragraph (2) of subdivision (h) of Section 65589.5.
                                                        </html:p>
                                                        <html:p>
                                                                (3)
                                                                <html:span class="EnSpace"/>
                                                                “State Historic Resources Inventory” has the same meaning as defined in Section 5020.1 of the Public Resources Code.
                                                        </html:p>
                                                        <html:p>
                                                                (c)
                                                                <html:span class="EnSpace"/>
                                                                A city, county, or city and county shall administratively approve an application to replace existing residential windows with California Energy Code-compliant windows.
                                                        </html:p>
                                                        <html:p>
                                                                (d)
                                                                <html:span class="EnSpace"/>
                                                                A city, county, or city and county shall not require discretionary review or a hearing for a residential window replacement project that is limited to replacing existing windows with California Energy Code-compliant windows and does not involve any physical alterations to the existing structure beyond those necessary to install those windows.
                                                        </html:p>
                                                        <html:p>
                                                                (e)
                                                                <html:span class="EnSpace"/>
                                                                A city, county, or city and county shall not deny an application for a
                                                permit to replace existing windows with California Energy Code-compliant windows unless it makes written findings, based upon substantial evidence in the record, that the proposed replacement would have a specific, adverse impact upon public health or safety and there is no feasible method to satisfactorily mitigate or avoid the specific, adverse impact.
                                                        </html:p>
                                                        <html:p>
                                                                (f)
                                                                <html:span class="EnSpace"/>
                                                                Any conditions imposed on a residential window replacement shall be limited to objective conditions that are necessary to mitigate a specific, adverse impact upon public health or safety identified pursuant to subdivision (e).
                                                        </html:p>
                                                        <html:p>
                                                                (g)
                                                                <html:span class="EnSpace"/>
                                                                A city, county, or city and county shall not impose any conditions on California Energy Code-compliant windows proposed in a housing development
                                                project other than objective conditions that are necessary to mitigate a specific adverse impact upon public health or safety. A city, county, or city and county shall make written findings, based upon substantial evidence in the record, that the proposed California Energy Code-compliant window would have a specific, adverse impact upon public health or safety.
                                                        </html:p>
                                                        <html:p>
                                                                (h)
                                                                <html:span class="EnSpace"/>
                                                                This section shall not apply to either of the following:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                A residential structure that is individually listed as a historical resource in the State Historic Resources Inventory, provided
                                                that the parcel or structure was designated prior to the date an application to replace existing residential windows with California Energy Code-compliant windows is submitted.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                A residential structure individually designated or listed as a city or county landmark under a city or county ordinance or a residential structure on a site designated as a historical resource on a local register. A local ordinance that designates multiple properties as
                                                historical based solely on the age of the structure, or an ordinance that designates a district or neighborhood as historical, does not constitute an ordinance that individually identifies a structure as a city or county landmark.

                                <html:p>
                                         No reimbursement is required by this act pursuant to Section 6 of Article XIII
                                        <html:span class="ThinSpace"/>
                                        B of the California Constitution because a local agency or school district has the authority to levy service charges, fees, or assessments sufficient to pay for the program or level of service mandated by this act, within the meaning of Section 17556 of the Government Code.
                                </html:p>
