                        <html:p>Existing law generally regulates classes of insurance, including residential property insurance. Existing law prohibits a policy of residential property insurance from being issued or renewed by an insurer unless the named insured is provided a copy of specified information, including the California Residential Insurance Disclosure. Under existing law, the California Standard Form Fire Insurance Policy requires an insured to notify every claimant that they can request copies of claim-related documents, as defined, that the insurer is required to provide within 15 calendar days of the request.</html:p>
                        <html:p>This bill would require an insurer, in the event of a covered loss under a policy of residential property insurance, to provide the named insured every version of a claim-related document, as defined, within 15 calendar days of the creation or generation of
                the document. The bill would require the insurer to include the full name and title of every person who made, ordered, reviewed, or approved a change to the versions provided and a detailed explanation of why the change was made.</html:p>

                                                                (a)
                                                                <html:span class="EnSpace"/>
                                                                In the event of a covered loss under a policy of residential property insurance, the insurer shall provide the named insured a copy of all claim-related documents within 15 calendar days after the document has been created or generated.
                                                        </html:p>
                                                        <html:p>
                                                                (b)
                                                                <html:span class="EnSpace"/>
                                                                The claim-related documents provided to the named insured, including, but not limited to, the loss estimate prepared by a person who is acting on behalf of the insurer, beginning with the initial report, estimate, or other document, shall include every newly printed version and every altered, amended, edited, revised, or redacted version, changed in any way, whether done electronically or by hand. The provided documents shall also be accompanied by the full name and title of every person who made,
                                  ordered, reviewed, or approved a change to the version of the provided claim-related document and a detailed explanation of why the change was made.

                                                                Disclosure shall be made in the insurer’s document portal or through another primary method the insurer provides claim-related documents and communications to the insured. The documents shall not be removed from this location or altered after disclosure.

                                                                (d)
                                                                <html:span class="EnSpace"/>
                                                                For purposes of this section, “claim-related documents” means all documents that relate to the evaluation of damages, including, but not limited to, repair and replacement estimates and bids, appraisals, scopes of loss, drawings, plans, reports, third-party findings on the amount of loss, covered damages, and cost of repairs, and all other valuation, measurement, and loss adjustment calculations of the amount of loss, covered damage, and cost of repairs. However, attorney
                                  work product and attorney-client privileged documents, and documents that indicate fraud by the insured or that contain medically privileged information, are excluded from the documents an insurer is required to provide pursuant to this section.
