<ns0:Title> An act to amend Sections 14526 and 14527 of the Government Code, and to amend Sections 2380, 2381, and 2382 of, and to amend the heading of Chapter 8 (commencing with Section 2380) of Division 3 of, the Streets and Highways Code, relating to transportation.</ns0:Title>

<html:p>Existing law generally provides for programming and allocation of available state and federal transportation funds for transportation capital improvement projects through the state transportation improvement program process administered by the California Transportation Commission. Existing law requires 25% of available funds to be programmed and expended on interregional improvement projects nominated by the Department of Transportation through the adoption of an interregional transportation improvement program, and 75% of available funds to be programmed and expended on regional improvement projects nominated by transportation planning agencies through the adoption of a regional transportation improvement program.</html:p>
<html:p>This bill would require at least 50% of funds programmed in the interregional transportation improvement program, and 50% of funds programmed in a regional transportation improvement program, to be programmed for safe streets projects, as specified. The bill would require those funds to be prioritized for safe streets projects located in areas of transit-oriented development zones, as defined, that lack adequate pedestrian safety and mobility access.</html:p>
<html:p>Existing law establishes the Active Transportation Program in the Department of Transportation for the purpose of encouraging increased use of active modes of transportation, such as biking and walking. Existing law requires the California Transportation Commission to develop guidelines with regard to project selection that include, among other criteria, the benefit to disadvantaged communities and the potential for increasing and improving connectivity and mobility of
nonmotorized users. Existing law requires the guidelines adopted by the commission for the program to address, among other things, application timelines and application rating and ranking criteria.</html:p>
<html:p>This bill would rename the Active Transportation Program as the Safe Streets Program. The bill would require the guidelines with regard to project selection to also include as criteria the benefit to transit-oriented development zones, as defined. The bill would require the guidelines to establish an application process under which an applicant submits an initial application that would not require detailed engineering drawings and, if that application is deemed to be in conformance with the guidelines and project selection criteria, the applicant would be requested to submit a final and more comprehensive application for review.</html:p>

<ns0:Num>SECTION 1.</ns0:Num>
<ns0:Content>
<html:p>The Legislature finds and declares all of the following:</html:p>
<html:p>
(a)
<html:span class="EnSpace"/>
Increasing active transportation is essential to reducing vehicle miles traveled and meeting greenhouse gas reduction targets.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
Active transportation infrastructure, including protected bike lanes and safe crossings, significantly improves safety for children, seniors, and persons with disabilities, who are disproportionately impacted by traffic violence.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
Projects such as first- and last-mile connections and trails deliver high-return benefits to local economies and transit ridership at a fraction of the cost of traditional roadway expansion.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
Access to safe outdoor spaces for walking and rolling contributes to improved physical and mental health outcomes for all Californians.
</html:p>
<html:p>
(e)
<html:span class="EnSpace"/>
Under current practice, active transportation projects compete poorly in regional transportation improvement programs, and smaller counties often lack the fiscal capacity to advance nonautomobile projects.
</html:p>
<html:p>
(f)
<html:span class="EnSpace"/>
To achieve equity and safety, the state must distinguish between genuine active transportation investments and roadway widenings that offer only incidental pedestrian improvements.

(a)
<html:span class="EnSpace"/>
Not later than October 15 of each odd-numbered year, based on the guidelines established pursuant to Section 14530.1, and after consulting with the transportation planning agencies, county transportation commissions, and transportation authorities, the department shall submit to the commission the draft five-year interregional transportation improvement program consisting of all of the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Projects to improve state highways, pursuant to subdivision (b) of Section 164 of the Streets and Highways Code.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Projects to improve the intercity passenger rail system.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Projects to improve interregional movement of people,
vehicles, and goods.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
Projects included in the interregional transportation improvement program shall be consistent with the state interregional transportation strategic plan prepared pursuant to Section 14524.4.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
Projects may not be included in the draft interregional transportation improvement program without a project study report or major investment study.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
Major projects shall include current costs updated as of November 1 of the year of submittal and escalated to the appropriate year, and shall be consistent with, and provide the information required in, subdivision (b) of Section 14529.
</html:p>
<html:p>
(e)
<html:span class="EnSpace"/>
Projects included in the draft interregional transportation improvement program shall be consistent with the adopted regional transportation
plan.
</html:p>
<html:p>
(f)
<html:span class="EnSpace"/>
(1)
<html:span class="EnSpace"/>
At least 50 percent of the funds programmed in the interregional transportation improvement program shall be programmed for safe streets projects. The funds programmed pursuant to this subdivision shall be prioritized in the interregional transportation improvement program for safe streets projects located in areas of transit-oriented development zones that lack adequate pedestrian safety and mobility access.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
For purposes of this subdivision, the following definitions apply:
</html:p>
<html:p>
(A)
<html:span class="EnSpace"/>
“Safe
streets project” means a project that meets all of the goals set forth in paragraphs (1) to (3), inclusive, of subdivision (b) of Section 2380 of the Streets and Highways Code. Safe streets projects include sidewalk and curb ramp networks, protected bicycle facilities, safe crossings, traffic calming measures, and Safe Routes to School projects. A project consisting of roadway widening or capacity expansion shall not be classified as a safe streets project solely because it includes incidental bicycle lanes or sidewalks.
</html:p>
<html:p>
(B)
<html:span class="EnSpace"/>
“Transit-oriented development zone” has the same meaning as defined in Section 65912.156.
</html:p>
<html:p>
(g)
<html:span class="EnSpace"/>
On or before November 15 of each odd-numbered year, the commission shall hold at least one hearing in northern California and one hearing in southern California to attempt to reconcile any objections by any member of the public or other stakeholder to the draft interregional transportation improvement program.
</html:p>
<html:p>
(h)
<html:span class="EnSpace"/>
The department shall consider the input received at the hearings conducted pursuant to subdivision (g) and shall develop a final interregional
transportation improvement program. The final interregional transportation improvement program shall include a summary of the major comments received at the hearings and responses to those comments, and shall be submitted to the commission for approval not later than December 15 of each odd-numbered year.

(i)
<html:span class="EnSpace"/>
The commission shall, when approving the final interregional transportation improvement program pursuant to subdivision (h), evaluate the extent to which the program is
consistent with funding priorities established in Section 167 of the Streets and Highways Code.

(a)

After consulting with the department, the regional transportation planning agencies and county transportation commissions shall adopt and submit to the commission and the department, not later than December 15, 2001, and December 15 of each odd-numbered year thereafter, a five-year regional transportation improvement program in conformance with Section 65082. In counties where a county transportation commission has been created pursuant to Chapter 2 (commencing with Section 130050) of Division 12 of the Public Utilities Code, that commission shall adopt and submit the county transportation improvement program, in conformance with Sections 130303 and 130304 of that code, to the multicounty-designated transportation planning agency. Other information, including a program for expenditure of local or federal funds, may be
submitted for information purposes with the program, but only at the discretion of the transportation planning agencies or the county transportation commissions. As used in this section, “county transportation commission” includes a transportation authority created pursuant to Chapter 2 (commencing with Section 130050) of Division 12 of the Public Utilities Code.

(b)
<html:span class="EnSpace"/>

The regional transportation improvement program shall include all projects to be funded with the county share under paragraph (2) of subdivision (a) of Section 164 of the Streets and Highways Code. The regional programs shall be limited to projects to be funded in whole or in part with the county share that shall include all projects to receive
allocations by the commission during the following five fiscal years. For each project, the total expenditure for each project component and the total amount of commission allocation and the year of allocation shall be stated. The total cost of projects to be funded with the county share shall not exceed the amount specified in the fund estimate made by the commission pursuant to Section 14525.

(2)
<html:span class="EnSpace"/>
(A)
<html:span class="EnSpace"/>
At least 50 percent of the funds described paragraph (1) shall be programmed in the regional transportation improvement program for safe streets projects. The funds programmed pursuant to this paragraph shall be prioritized in the regional transportation improvement program for safe streets projects located in areas of transit-oriented development zones that lack adequate pedestrian safety and mobility access.

(B)
<html:span class="EnSpace"/>
Subparagraph (A) does not apply to any portion of a county share reserved before January 1, 2027, for a future programming year pursuant to Section 188.8 of the Streets and Highways Code.
</html:p>
<html:p>
(C)
<html:span class="EnSpace"/>
For purposes of this paragraph, the following definitions apply:
</html:p>
<html:p>
(i)
<html:span class="EnSpace"/>
“Safe streets project” means a project that meets all of the goals set forth in paragraphs (1) to (3), inclusive, of subdivision (b) of Section 2380 of the Streets and Highways Code. Safe streets projects include sidewalk and curb ramp networks, protected bicycle facilities, safe crossings, traffic calming measures, and Safe Routes to School projects. (c)
<html:span class="EnSpace"/>
The regional transportation planning agencies and county transportation commissions may recommend projects to improve state highways with the interregional share pursuant to subdivision (b) of Section 164 of the Streets and Highways Code. The recommendations shall be separate and distinct from the regional transportation improvement program. A project recommended for funding pursuant to this subdivision shall constitute a usable segment and shall not be a condition for inclusion of other projects in the regional transportation improvement program.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
The department may nominate or recommend the inclusion of projects in the regional transportation improvement program to improve state highways with the county share pursuant to paragraph (2) of subdivision (a) and subdivision (e) of Section 164 of the Streets and Highways Code. A regional transportation planning agency and a county transportation commission shall have sole authority for determining whether any of the project nominations or recommendations are accepted and included in the regional transportation improvement program adopted and submitted pursuant to this section. This authority provided to a regional transportation planning agency or to a county transportation commission extends only to a project located within its jurisdiction.

(e)
<html:span class="EnSpace"/>
Major projects shall include current costs updated as of November 1 of the year of submittal and escalated to the appropriate year,
and shall be consistent with, and provide the information required in, subdivision (b) of Section 14529.
</html:p>
<html:p>
(f)
<html:span class="EnSpace"/>
The regional transportation improvement program may not change the project delivery milestone date of any project as shown in the prior adopted state transportation improvement program without the consent of the department or other agency responsible for the project’s delivery.
</html:p>
<html:p>
(g)
<html:span class="EnSpace"/>
Projects may not be included in the regional transportation improvement program without a complete project study report or, for a project that is not on a state highway, a project study report equivalent or major investment study.
</html:p>
<html:p>
(h)
<html:span class="EnSpace"/>

<html:span class="EnSpace"/>
Each transportation planning agency and county transportation commission may request and receive an amount not to exceed 5 percent of its county share for the purposes of
project planning, programming, and monitoring.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Notwithstanding any other law, but to the extent consistent with applicable federal law or regulation, the department may make an advance payment up to three hundred thousand dollars ($300,000) per year to transportation planning agencies and county transportation commissions for programming, planning, and monitoring under paragraph (1) where the total allocation under that paragraph is equal to or less than three hundred thousand dollars ($300,000). Funds advanced shall be programmed in the State Transportation Improvement Program and allocated by the California Transportation Commission prior to payment.

(b)
<html:span class="EnSpace"/>
It is the intent of the Legislature that the program achieve all of the following goals:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Increase the proportion of trips accomplished by biking and walking.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Increase safety and mobility for nonmotorized users.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Advance the active transportation efforts of regional agencies to achieve greenhouse gas reduction goals as established pursuant to Senate Bill 375 (Chapter 728 of the Statutes of 2008) and Senate Bill 391 (Chapter
585 of the Statutes of 2009).
</html:p>
<html:p>
(4)
<html:span class="EnSpace"/>
Enhance public health, including reduction of childhood obesity through the use of programs including, but not limited to, projects eligible for Safe Routes to School Program funding.
</html:p>
<html:p>
(5)
<html:span class="EnSpace"/>
Ensure that disadvantaged communities fully share in the benefits of the program.
</html:p>
<html:p>
(6)
<html:span class="EnSpace"/>
Provide a broad spectrum of projects to benefit many types of active transportation users.

The Safe Streets Program shall be funded by state and federal funds from appropriations in the annual Budget Act. Funds for the program shall be appropriated to the department, for allocation by the commission. The amount to be appropriated shall include 100 percent of the federal Transportation Alternative Program funds described in Section 133(h) of Title 23 of the United States Code, except for any federal funds for recreational trails projects described in Section 133(h)(5) of Title 23 of the United States Code appropriated to the Department of Parks and Recreation; twenty-one million dollars ($21,000,000) of
federal Highway Safety Improvement funds or other federal funds; and State Highway Account funds. Future funding may be augmented if state or federal funds increase, or if other funding sources are identified. Funds appropriated for the Safe Streets Program shall be distributed as follows:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Forty percent to metropolitan planning organizations in urban areas with populations greater than 200,000, in proportion to their relative share of population. Funds allocated under this paragraph shall be obligated for eligible projects selected through a competitive process by the metropolitan planning organizations in consultation with the department and the commission and in accordance with guidelines established pursuant to this
chapter.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Ten percent to small urban and rural regions with populations of 200,000 or less, with projects competitively awarded by the commission to projects in those regions.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Fifty percent to projects competitively awarded by the commission on a statewide basis.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
For the purpose of paragraph (1) of subdivision (a), the following shall apply in the region served by the multicounty designated transportation planning agency described in Section 130004 of the Public Utilities Code:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
The multicounty designated transportation planning agency shall consult with the county transportation commissions created pursuant to Sections 130050, 130050.1, and 132800 of the Public Utilities Code, the commission, and the department in the development of
competitive selection criteria to be adopted by the multicounty designated transportation planning agency, which should include consideration of geographic equity, consistent with program objectives.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
The multicounty designated transportation planning agency shall place priority on projects that are consistent with plans adopted by local and regional governments within the county where the project is located.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
The multicounty designated transportation planning agency shall obtain concurrence from the county transportation commissions, adopt the projects selected in a comprehensive program of projects, and make funds available to selected project recipients.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
The Legislature finds and declares that the program described in this chapter constitutes a highway purpose under Article XIX of the California
Constitution and justifies the expenditure of highway funds therefor, and all expenditures of Article XIX funds under this program shall be consistent with Article XIX.

(a)

The California Transportation Commission shall develop guidelines and project selection criteria for the Safe Streets Program in consultation with the Safe Streets Program Workgroup, which shall be formed for purposes of providing guidance on matters including, but not limited to, development of and subsequent revisions to program guidelines, schedules and procedures, project selection criteria,
performance measures, and program evaluation. The workgroup shall include, but not be limited to, representatives of government agencies and active transportation stakeholder organizations with expertise in pedestrian and bicycle issues, including Safe Routes to School programs.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
(1)
<html:span class="EnSpace"/>
The guidelines shall be the complete and full statement of the policies and criteria that the commission intends to use in selecting projects to be included in the program. The guidelines shall address subjects that include, but are not limited to, project eligibility, application timelines, application rating and ranking criteria, project monitoring, reporting, and transparency, and project performance measurement.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
The guidelines shall establish an application process under which an applicant submits an initial application that shall not require detailed engineering drawings and, if that application is deemed to be in conformance with the guidelines and project selection criteria, the applicant shall be requested to submit a final and more comprehensive application for review.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
The guidelines shall include a process to ensure that no less than 25 percent of overall program funds benefit disadvantaged communities during each program cycle. The guidelines shall establish a program definition for disadvantaged communities that may include, but need not be limited to, the definition in Section 39711 of the Health and Safety Code and the definition of low-income schools in paragraph (7) of subdivision (b) of former Section 2333.5, as that section read on January 1,
2013. A project eligible under this subdivision shall clearly demonstrate a benefit to a disadvantaged community or be directly located in a disadvantaged community.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
The guidelines shall allow streamlining of project delivery by authorizing an implementing agency to seek commission approval of a letter of no prejudice that will allow the agency to expend its own funds for a project programmed in a future year of the adopted program of projects, in advance of allocation of funds to the project by the commission, and to be reimbursed at a later time for eligible expenditures.
</html:p>
<html:p>
(e)
<html:span class="EnSpace"/>
The California Transportation Commission shall adopt the guidelines and selection criteria for, and define the types of projects eligible to be funded through, the program following at least two public hearings. Projects funded in this program shall be limited to active transportation projects. The
guidelines shall ensure that eligible projects meet one or more of the goals set forth in Section 2380 and may give increased weight to projects meeting multiple goals.
</html:p>
<html:p>
(f)
<html:span class="EnSpace"/>
In developing the guidelines with regard to project eligibility, the commission shall include, but need not be limited to, the following project types:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Development of new bikeways and walkways, or improvements to existing bikeways and walkways, that improve mobility, access, or safety for nonmotorized users. On and after January 1, 2026, the guidelines with regard to project eligibility shall not include the development of Class III bikeways, as described in Section 890.4, or the marking in Figure 9C-9 of the 2014 California Manual on Uniform Traffic Control Devices, Revision 8, unless any of the following apply:
</html:p>
<html:p>
(A)
<html:span class="EnSpace"/>
The Class III bikeway or
marking is on a highway with a design speed limit of 25 miles per hour or less.
</html:p>
<html:p>
(B)
<html:span class="EnSpace"/>
The project will implement improvements to reduce the design speed limit to 25 miles per hour or less.
</html:p>
<html:p>
(C)
<html:span class="EnSpace"/>
The project applicant demonstrates that the use of the Class III bikeway or marking is appropriate for the local community context and advances a lower stress environment or a low-stress network.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Secure bicycle parking at employment centers, park and ride lots, rail and transit stations, and ferry docks and landings.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Bicycle-carrying facilities on public transit, including rail and ferries.
</html:p>
<html:p>
(4)
<html:span class="EnSpace"/>
Installation of traffic control devices to improve the safety of pedestrians and bicyclists.
</html:p>
<html:p>
(5)
<html:span class="EnSpace"/>
Elimination of hazardous conditions on existing bikeways and walkways.
</html:p>
<html:p>
(6)
<html:span class="EnSpace"/>
Maintenance of bikeways and walkways.
</html:p>
<html:p>
(7)
<html:span class="EnSpace"/>
Recreational trails and trailheads, park projects that facilitate trail linkages or connectivity to nonmotorized corridors, and conversion of abandoned railroad corridors to trails.
</html:p>
<html:p>
(8)
<html:span class="EnSpace"/>
Safe Routes to School projects that improve the safety of children walking and bicycling to school, in accordance with Section 1404 of Public Law 109-59.
</html:p>
<html:p>
(9)
<html:span class="EnSpace"/>
Safe routes to transit projects, which will encourage transit by improving biking and walking routes to mass transportation facilities and schoolbus stops.
</html:p>
<html:p>
(10)
<html:span class="EnSpace"/>
Educational programs to increase biking and walking, and other noninfrastructure investments that demonstrate effectiveness in increasing active transportation.
</html:p>
<html:p>
(g)
<html:span class="EnSpace"/>
In developing the guidelines with regard to project selection, the commission shall include, but need not be limited to, the following criteria:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Demonstrated needs of the applicant.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Potential for reducing pedestrian and bicyclist injuries and fatalities.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Potential for encouraging increased walking and bicycling, especially among students.
</html:p>
<html:p>
(4)
<html:span class="EnSpace"/>
Identification of safety hazards for pedestrians and bicyclists.
</html:p>
<html:p>
(5)
<html:span class="EnSpace"/>
Identification of walking
and bicycling routes to and from schools, transit facilities, and community centers.
</html:p>
<html:p>
(6)
<html:span class="EnSpace"/>
Identification of the local public participation process that culminated in the project proposal, which may include noticed public meetings and consultation with local stakeholders.
</html:p>
<html:p>
(7)
<html:span class="EnSpace"/>
Benefit to disadvantaged communities. In developing guidelines relative to this paragraph, the commission shall consider, but need not be limited to, the definition of disadvantaged communities as applied pursuant to subdivision (c).
</html:p>
<html:p>
(8)
<html:span class="EnSpace"/>
Benefit to transit-oriented development zones, as defined in Section 65912.156 of the Government Code.
</html:p>
<html:p>
(9)
<html:span class="EnSpace"/>
Cost-effectiveness, defined as maximizing the impact of the funds provided.
</html:p>
<html:p>
(10)
<html:span class="EnSpace"/>
The adoption by a city or county applicant of a bicycle transportation plan, pursuant to Section 891.2, a pedestrian plan, a safe routes to school plan, or an overall active transportation plan.
</html:p>
<html:p>
(11)
<html:span class="EnSpace"/>
Use of the California Conservation Corps or a qualified community conservation corps, as defined in Section 14507.5 of the Public Resources Code, as partners to undertake or construct applicable projects in accordance with Section 1524 of Public Law 112-141.
</html:p>
<html:p>
(12)
<html:span class="EnSpace"/>
Other factors, such as potential for reducing congestion, improving air quality, reducing greenhouse gas emissions, and increasing and improving connectivity and mobility of nonmotorized users. On and after January 1, 2026, increasing or improving connectivity of nonmotorized users shall not include the addition of a bikeway connecting to a Class III bikeway, as described in Section 890.4, or
the marking in Figure 9C-9 of the 2014 California Manual on Uniform Traffic Control Devices, Revision 8, unless the bikeway or marking is on a highway with a design speed limit of 25 miles per hour or less or the project will implement improvements to reduce the design speed limit to 25 miles per hour or less.
</html:p>
<html:p>
(h)
<html:span class="EnSpace"/>
For the use of federal Transportation Alternative Program funds, or other federal funds, commission guidelines shall meet all applicable federal requirements.
</html:p>
<html:p>
(i)
<html:span class="EnSpace"/>
For the use of federal Highway Safety Improvement Program funds for active transportation projects specific to reducing fatalities and serious injuries, the criteria for the selection of projects shall be based on a data-driven process that is aligned with the state’s Strategic Highway Safety Plan.
</html:p>
<html:p>
(j)
<html:span class="EnSpace"/>
The guidelines may include incentives
intended to maximize the potential for attracting funds other than program funds for eligible projects.
</html:p>
<html:p>
(k)
<html:span class="EnSpace"/>
In reviewing and selecting projects funded by federal funds in the Recreational Trails Program, the commission shall collaborate with the Department of Parks and Recreation to evaluate proposed projects, and to ensure federal requirements are met.

To ensure that regional agencies charged with allocating funds to projects pursuant to paragraph (1) of subdivision (a) of Section 2381 have sufficient discretion to develop regional guidelines, the commission may adopt separate guidelines for the state and for the regional agencies relative to subdivision (g).
