<ns0:Title> An act to add Section 21080.76 to the Public Resources Code, relating to environmental quality.</ns0:Title>
<ns0:RelatingClause>environmental quality</ns0:RelatingClause>
<ns0:GeneralSubject>
<ns0:Subject>California Environmental Quality Act: exemptions: City of San Jose: Diridon Station.</ns0:Subject>
</ns0:GeneralSubject>
<ns0:DigestText>
<html:p>The California Environmental Quality Act (CEQA) requires a lead agency, as defined, to prepare, or cause to be prepared, and certify the completion of, an environmental impact report on a project that it proposes to carry out or approve that may have a significant effect on the environment or to adopt a negative declaration if it finds that the project will not have that effect. CEQA also requires a lead agency to prepare a mitigated negative declaration for a project that may have a significant effect on the environment if revisions in the project would avoid or mitigate that effect and there is no substantial evidence that the project, as revised, would have a significant effect on the environment.</html:p>
<html:p>Existing law exempts from CEQA a public
project for the improvement, institution, or increase of passenger rail service, including the maintenance, construction, or rehabilitation of stations, terminals, or existing operations facilities that will be exclusively used by zero-emission trains or specified rolling stock or locomotives, as provided. </html:p>
<html:p>This bill would exempt from CEQA a public program for the modernization of Diridon Station in the City of San Jose, including, but not limited to, the track, platform, station, public plaza or realm, roadway crossing and access improvements, and intermodal facilities and connections. Because a lead agency would be required to determine the applicability of this exemption, the bill would impose a state-mandated local program.</html:p>
<html:p>This bill would make legislative findings and declarations as to the necessity of a special statute for the Diridon Station Program in the County of Santa Clara.</html:p>
<html:p>The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.</html:p>
<html:p>This bill would provide that no reimbursement is required by this act for a specified reason.</html:p>

<ns0:Num>SECTION 1.</ns0:Num>
<ns0:Content>
<html:p>The Legislature finds and declares all of the following:</html:p>
<html:p>
(a)
<html:span class="EnSpace"/>
The Diridon Station Program in the City of San Jose is the confluence of major rail and transit projects, including the Bay Area Rapid Transit Silicon Valley Phase II Extension, intercity and commuter rail, high-speed rail, light rail, and local, rapid, and intercity bus projects.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
Environmental review has already been completed for major transit projects and land use plans at
and around Diridon Station, including, but not limited to, environmental review for the statewide high-speed rail project that environmentally cleared minimal changes to introduce high-speed rail tracks and platforms and ensure access to them.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
The integrated Diridon Station Program comprehensively designs for all rail and transit needs at the station, including, but not limited to, the statewide high-speed rail project, and seamless connections between modes.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
The modernized station will result in an integrated transit hub that advances environmental sustainability, creates new jobs, supports surrounding transit-oriented communities and homes, and catalyzes sustainable economic and community development.
