                        <html:p>Existing law governs the obligations of tenants and landlords. Existing law prohibits a landlord who allows an animal on the premises from advertising or establishing rental policies in a manner that requires a tenant or a potential tenant with an animal to have that animal declawed or devocalized as a condition of occupancy, as provided.</html:p>
                        <html:p>This bill would require a landlord who allows an animal on the premises to include their pet policy in specified locations, including advertisements and rental application forms, as provided. The bill would require prescribed information be included in the pet policy, including any breed and weight restrictions, as provided. The bill would require a prospective tenant to acknowledge receipt of the pet policy, as specified. The bill would require any landlord who charges an application fee but fails to disclose
                their pet policy before charging the fee to refund the application fee to the applicant, as specified.</html:p>

                                                        <html:p>
                                                                (a)
                                                                <html:span class="EnSpace"/>
                                                                A person or corporation that occupies, owns, manages, or provides services in connection with any real property, including the individual’s or corporation’s agents or successors in interest, and that allows an animal on the premises, shall do all of the following:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                Provide a link or other electronic means to access the property’s pet policy in all of the following, as applicable:
                                                        </html:p>
                                                        <html:p>
                                                                (A)
                                                                <html:span class="EnSpace"/>
                                                                On the property’s internet website.
                                                        </html:p>
                                                        <html:p>
                                                                (B)
                                                                <html:span class="EnSpace"/>
                                                                As part of any digital advertisement for the property.
                                                        </html:p>
                                                        <html:p>
                                                                (C)
                                                                <html:span class="EnSpace"/>
                                                                In any information provided for a residential rental search
                                  engine.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                Provide a written copy or summary of the property’s pet policy in any rental application form for a unit in the property.
                                                        </html:p>
                                                        <html:p>
                                                                (3)
                                                                <html:span class="EnSpace"/>
                                                                Maintain and post a written copy or summary of the property’s pet policy in a conspicuous location visible to prospective tenants.
                                                        </html:p>
                                                        <html:p>
                                                                (b)
                                                                <html:span class="EnSpace"/>
                                                                A pet policy provided in accordance with this section shall state all of the following:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                Any breed and weight restrictions.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                Any required fees, including all of the following:
                                                        </html:p>
                                                        <html:p>
                                                                (A)
                                                                <html:span class="EnSpace"/>
                                                                Upfront, nonrefundable pet fees.
                                                        </html:p>
                                                        <html:p>
                                                                (B)
                                                                <html:span class="EnSpace"/>
                                                                Refundable pet deposits.
                                                        </html:p>
                                                        <html:p>
                                                                (C)
                                                                <html:span class="EnSpace"/>
                                                                Monthly pet fees.
                                                        </html:p>
                                                        <html:p>
                                                                (3)
                                                                <html:span class="EnSpace"/>
                                                                Any limit on the number of pets allowed in a unit.
                                                        </html:p>
                                                        <html:p>
                                                                (4)
                                                                <html:span class="EnSpace"/>
                                                                Any vaccination requirements.
                                                        </html:p>
                                                        <html:p>
                                                                (5)
                                                                <html:span class="EnSpace"/>
                                                                Any liability insurance requirements.
                                                        </html:p>
                                                        <html:p>
                                                                (6)
                                                                <html:span class="EnSpace"/>
                                                                Any additional requirements for pet owners imposed by the policy.
                                                        </html:p>
                                                        <html:p>
                                                                (c)
                                                                <html:span class="EnSpace"/>
                                                                A prospective tenant shall acknowledge receipt of the pet policy by either of the following means:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                Signing a pet addendum, the terms of which include the full pet policy.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                Signing a lease agreement, the terms of which include the full pet policy.
                                                        </html:p>
                                                        <html:p>
                                                                (d)
                                                                <html:span class="EnSpace"/>
                                                                If a landlord or their agent charges an application fee pursuant to Section 1950.6 but fails to disclose the pet policy in accordance with this section before charging the fee, the landlord or their agent shall return the application fee to the applicant.
                                                        </html:p>
