                        <html:p>Existing law establishes the Department of Motor Vehicles in the Transportation Agency and sets forth the powers and duties of the department, as specified. Existing law regulates the accuracy of information provided to consumers during vehicle sales, including the information contained in advertising, brochures, and manuals, as specified. Existing law also requires a buy-here-pay-here dealer to disclose certain information regarding a used vehicle by affixing a label with certain information on the vehicle. Existing law prohibits a buy-here-pay-here dealer from disabling the vehicle using starter interrupt technology, unless certain conditions are met, and makes a violation of those provisions a misdemeanor. Existing law defines a “buy-here-pay-here” dealer as, among other things, a dealer who assigns less than 90% of all unrescinded conditional sale contracts and lease contracts to
                unaffiliated third-party finance or leasing sources within 45 days of the consummation of those contracts. </html:p>
                        <html:p>This bill would amend that definition and extend that deadline to within 46 days of the consummation of those contracts. By expanding the application of an existing crime to more persons, this bill would impose a state-mandated local program.</html:p>
                        <html:p>The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.</html:p>
                        <html:p>This bill would provide that no reimbursement is required by this act for a specified reason.</html:p>

                                Section 241 of the

                                 is amended to read:

                                                        <html:p>A “buy-here-pay-here” dealer is a dealer, as defined in Section 285, who is not otherwise expressly excluded by Section 241.1, and who does all of the following:</html:p>
                                                        <html:p>
                                                                (a)
                                                                <html:span class="EnSpace"/>
                                                                Enters into conditional sale contracts, within the meaning of subdivision (a) of Section 2981 of the Civil Code, and subject to the provisions of Chapter 2b (commencing with Section 2981) of Title 14 of Part 4 of Division 3 of the Civil Code, or lease contracts, within the meaning of Section 2985.7 of the Civil Code, and subject to the provisions of Chapter 2d (commencing with Section 2985.7) of Title 14 of Part 4 of Division 3 of the Civil Code.

                                                                (b)
                                                                <html:span class="EnSpace"/>
                                                                Assigns less than 90 percent of all unrescinded conditional sale contracts and lease contracts to unaffiliated
                                  third-party finance or leasing sources within
                                  46 days of the consummation of those contracts.

                                                                <html:span class="EnSpace"/>
                                                                For purposes of this section, a conditional sale contract does not include a contract for the sale of a motor vehicle if all amounts owed under the contract are paid in full within 30 days.

                                                                (d)
                                                                <html:span class="EnSpace"/>
                                                                The department may promulgate regulations as necessary to implement this section.

                                        No reimbursement is required by this act pursuant to Section 6 of Article XIII

                                        B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII
