<html:p>Under existing law, a person is guilty of sexual exploitation of a child if the person knowingly develops, duplicates, prints, or exchanges any representation of information, data, or image, including, but not limited to, any film, filmstrip, photograph, negative, slide, photocopy, videotape, video laser disc, computer hardware, computer software, computer floppy disc, data storage media, CD-ROM, or computer-generated equipment or any other computer-generated image that contains or incorporates in any manner, any film or filmstrip that depicts a person under 18 years of age engaged in an act of sexual conduct, as defined. Existing law makes a violation of this section punishable as a misdemeanor or a felony, as specified.</html:p>
<html:p>This bill would additionally make a person guilty of a misdemeanor or a felony if the person downloads, streams, or accesses
through electronic or digital media the above-described sexual conduct, except as specified. By expanding the scope of a crime, this bill would impose a state-mandated local program.</html:p>
<html:p>Existing law, the Child Abuse and Neglect Reporting Act, requires a mandated reporter, as defined, to make a report to a specified agency whenever the mandated reporter, in their professional capacity or within the scope of their employment, has knowledge of or observes a child whom the mandated reporter knows or reasonably suspects has been the victim of child abuse or neglect. For the purposes of this act, existing law includes sexual exploitation, and defines sexual exploitation as, among other things, a person who depicts a child in, or who knowingly develops, duplicates, prints, downloads, streams, accesses through any electronic or digital media, or exchanges, a film, photograph, videotape, video recording, negative, or slide in which a child is engaged in an act of obscene sexual
conduct, except as specified.</html:p>
<html:p>This bill would broaden the above-described definition to include any digitally altered or artificial-intelligence-generated matter that depicts a person under 18 years of age engaged in an act of sexual conduct, as specified.</html:p>
<html:p>The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.</html:p>
<html:p>This bill would provide that no reimbursement is required by this act for a specified reason.</html:p>

(a)
<html:span class="EnSpace"/>
A person is guilty of sexual exploitation of a child if that person knowingly develops, duplicates, prints, downloads, streams, accesses through electronic or digital media, or exchanges any representation of information, data, or image, including, but not limited to, any film, filmstrip, photograph, negative, slide, photocopy, videotape, video laser disc, computer hardware, computer software, computer floppy disc, data storage media, CD-ROM, or computer-generated equipment or any other computer-generated image that contains or incorporates in any manner, any film, filmstrip, or any digitally altered or artificial-intelligence-generated matter that depicts a person under 18 years of age engaged in an act of sexual
conduct.

(b)
<html:span class="EnSpace"/>
It is not necessary to prove that the matter is obscene in order to establish a violation of subdivision (a).
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
As used in this section, “sexual conduct” means any of the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Sexual intercourse, including genital-genital, oral-genital, anal-genital, or oral-anal, whether between persons of the same or opposite sex or between humans and animals.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Penetration of the vagina or rectum by any object.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Masturbation for the purpose of sexual stimulation of the viewer.
</html:p>
<html:p>
(4)
<html:span class="EnSpace"/>
Sadomasochistic abuse for the purpose of sexual stimulation of the viewer.
</html:p>
<html:p>
(5)
<html:span class="EnSpace"/>
Exhibition of the genitals or the pubic or rectal area of any person for the purpose of sexual stimulation of the viewer.
</html:p>
<html:p>
(6)
<html:span class="EnSpace"/>
Defecation or urination for the purpose of sexual stimulation of the viewer.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
Subdivision (a) does not apply to the activities of law enforcement and prosecution agencies in the investigation and prosecution of criminal offenses or to legitimate medical, scientific, or educational activities, or to lawful conduct between spouses.
</html:p>
<html:p>
(e)
<html:span class="EnSpace"/>
Every person who violates subdivision (a) shall be punished by a fine of not more than two thousand dollars ($2,000) or by imprisonment in a county jail for not more than one year, or by both that fine and imprisonment. If the person has been previously convicted of a violation of subdivision (a) or any section of this chapter, the person shall
be punished by imprisonment in the state prison.

(f)
<html:span class="EnSpace"/>
The provisions of this section do not apply to an employee of a commercial film developer who is acting within the scope of employment and in accordance with the instructions of their employer, provided that the employee has no financial interest in the commercial developer by which they are employed.
</html:p>
<html:p>
(g)
<html:span class="EnSpace"/>
Subdivision (a) does not apply to matter that is unsolicited and is received without knowledge or consent through a facility, system, or network over which the person or entity has no control.
</html:p>
<html:p>
(h)
<html:span class="EnSpace"/>
This section does not apply to a child under 18 years of age alleged to have solely engaged in viewing sexual conduct through a video stream.

<html:p>As used in this article, “sexual abuse” means sexual assault or sexual exploitation as defined by the following:</html:p>
<html:p>
(a)
<html:span class="EnSpace"/>
“Sexual assault” means conduct in violation of one or more of the following sections: Section 261 (rape), subdivision (d) of Section 261.5 (statutory rape), Section 264.1 (rape in concert), Section 285 (incest), Section 286 (sodomy), Section 287 or former Section 288a (oral copulation), subdivision (a) or (b) of, or paragraph (1) of subdivision (c) of, Section 288 (lewd or lascivious acts upon a child), Section 289 (sexual penetration), or Section 647.6 (child molestation). “Sexual assault” for the purposes of this article does not include voluntary conduct in violation of Section 286, 287, or 289, or former Section 288a, if there are no indicators of abuse, unless the
conduct is between a person 21 years of age or older and a minor who is under 16 years of age.

<html:p>
(b)
<html:span class="EnSpace"/>
Conduct described as “sexual assault” includes, but is not limited to, all of the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Penetration, however slight, of the vagina or anal opening of one person by the penis of another person, whether or not there is the emission of semen.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Sexual contact between the genitals or anal opening of one person and the mouth or tongue of another person.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Intrusion by one person into the genitals or anal opening of another person, including the use of an object for this purpose, except that, it does not include acts performed for a valid medical purpose.
</html:p>
<html:p>
(4)
<html:span class="EnSpace"/>
The intentional touching
of the genitals or intimate parts, including the breasts, genital area, groin, inner thighs, and buttocks, or the clothing covering them, of a child, or of the perpetrator by a child, for purposes of sexual arousal or gratification, except that it does not include acts which may reasonably be construed to be normal caretaker responsibilities; interactions with, or demonstrations of affection for, the child; or acts performed for a valid medical purpose.

<html:p>
(5)
<html:span class="EnSpace"/>
The intentional masturbation of the perpetrator’s genitals in the presence of a child.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
“Sexual exploitation” refers to any of the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Conduct involving matter depicting a minor engaged in obscene acts in violation of Section 311.2 (preparing, selling, or distributing obscene matter) or subdivision (a) of Section 311.4 (employment of minor to perform
obscene acts).
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
A person who knowingly promotes, aids, or assists, employs, uses, persuades, induces, or coerces a child, or a person responsible for a child’s welfare, who knowingly permits or encourages a child to engage in, or assist others to engage in, prostitution or a live performance involving obscene sexual conduct, or to either pose or model alone or with others for purposes of preparing a film, photograph, negative, slide, drawing, painting, or other pictorial depiction, involving obscene sexual conduct. For the purpose of this section, “person responsible for a child’s welfare” means a parent, guardian, foster parent, or a licensed administrator or employee of a public or private residential home, residential school, or other residential institution.

<html:p>
(3)
<html:span class="EnSpace"/>
A person who depicts a child in, or who knowingly develops, duplicates, prints, downloads, streams, accesses
through any electronic or digital media, or exchanges, a film, photograph, videotape, video recording, negative, or slide, or digitally altered or artificial-intelligence-generated matter that depicts a person under 18 years of age
engaged in an act of sexual conduct as described in subdivision (c) of Section 311.3, except for those activities by law enforcement and prosecution agencies and other persons described in subdivisions (d) and (f) of Section 311.3.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
“Commercial sexual exploitation” refers to either of the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
The sexual trafficking of a child, as described in subdivision (c) of
Section 236.1.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
The provision of food, shelter, or payment to a child in exchange for the performance of any sexual act described in this section or subdivision (c) of Section 236.1.

No reimbursement is required by this act pursuant to Section 6 of Article XIII

B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII
