<html:p>
(a)
<html:span class="EnSpace"/>
“Industrial city” means a city that meets all of the following criteria:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
The city has a resident population of fewer than 25,000.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
The city encompasses a total incorporated land area of less than 12.1 square miles.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
A majority of the city’s land area is zoned for, or primarily devoted to, industrial, manufacturing, logistics, warehouses, energy production, or other employment-generating commercial uses, rather than residential use.

<html:p>
(4)
<html:span class="EnSpace"/>
The city supports a daytime workforce that exceeds its resident population.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
A city meeting the definition in subdivision (a) shall be deemed an industrial city for purposes of any state program, policy, or funding formula that expressly references this section.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
This section shall not be construed to do any of the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Alter a city’s status as a general law city or charter city.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Limit or expand local land use authority.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Mandate residential development or changes to existing zoning.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
A state agency may adopt regulations or guidance necessary to implement this section provided that the regulations are consistent with, and do not expand, the criteria specified in subdivision
(a).
