<ns0:Title>An act to add Sections 25655 and 25657.5 to the Business and Professions Code, and to add Sections 13353.9 and 23590 to the Vehicle Code, relating to alcoholic beverages.</ns0:Title>

<html:p>Existing law, the Alcoholic Beverage Control Act, contains various provisions regulating the application for, the issuance of, and the suspension of alcoholic beverage licenses by the Department of Alcoholic Beverage Control. Existing law makes the sale of an alcoholic beverage to a person under 21 years of age a misdemeanor and authorizes a licensee to refuse to sell or serve alcoholic beverages to a person who is unable to produce adequate proof of age, including a document issued by a federal, state, county, or municipal government, a valid passport, or a valid identification card issued to a member of the Armed Forces, as specified. Existing law provides that a licensee’s acceptance of one of these documents constitutes a defense to any prosecution or proceedings against the licensee, as
specified.</html:p>
<html:p>Existing law makes it a crime to operate a vehicle while under the influence of alcohol or drugs, and sets forth the penalties for a violation of these provisions. Under existing law, if a person is convicted of a driving under the influence violation and the offense occurs within 10 years of one or more separate driving under the influence violations that resulted in convictions, the offense is subject to escalating fines, suspensions, and other sanctions.</html:p>
<html:p>This bill would require a court, when imposing a sentence for certain driving under the influence offenses to prohibit the person from purchasing alcohol for a period of 3 to 10 years and would require the Department of Motor Vehicles to issue an identification card or driver’s license with an appropriate designation on the face upon the receipt of an abstract of the record of a court. The bill would require the court to consider certain factors in imposing
the prohibition.</html:p>
<html:p>This bill would also require any person who sells or furnishes alcoholic beverages to request and review bona fide evidence of majority and identity, as defined, and would make a violation of this requirement a misdemeanor. The bill would also make the sale of an alcoholic beverage to an individual who provides the seller with an identification card or driver’s license displaying the described designation prohibiting the purchase of alcohol punishable as a misdemeanor.</html:p>
<html:p>Because the bill would create new crimes and to the extent it would require a higher level of service from court staff who are county employees, the bill would impose a state-mandated local program.</html:p>
<html:p>The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for
making that reimbursement.</html:p>
<html:p>This bill would provide that with regard to certain mandates no reimbursement is required by this act for a specified reason.</html:p>
<html:p>With regard to any other mandates, this bill would provide that, if the Commission on State Mandates determines that the bill contains costs so mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.</html:p>

(a)
<html:span class="EnSpace"/>
Notwithstanding any other law, every person who sells or causes to be sold any alcoholic beverage shall demand from the purchaser and review bona fide evidence of majority and identity, as defined in subdivision (a) of Section 25660.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
A violation of this section is a misdemeanor punishable by a fine of one thousand dollars ($1,000), no part of which shall be suspended, and the person shall be required to perform not less than 24 hours of community service during hours when the person is not employed and is not attending school.

Every person who sells or causes to be sold any alcoholic beverage to a person who provides the seller, pursuant to Section 25655, with an identification card or driver’s license issued pursuant to Section 13353.9 of the Vehicle Code is guilty of a misdemeanor. Proof that the defendant-licensee, or their employee or agent, demanded, was shown, and acted in reliance upon bona fide evidence of majority and identity, as defined in Section 25660 in any transaction shall be a defense to any criminal prosecution under this section or to any proceedings for the suspension or revocation of any license based thereon.

(b)

This section does not apply to the unknowing furnishing of alcohol by private individuals to those who are prohibited from
purchasing alcoholic beverages pursuant to Section 23590 of the Vehicle Code.

The department shall issue an identification card or a driver’s license with the words “NO ALCOHOL SALES” or another appropriate designation on the face of the identification card or driver’s license for an individual who has submitted an application and for whom the court department has received an abstract of the record of a court showing that the court has issued orders pursuant to Section 23590.

(b)
<html:span class="EnSpace"/>
The identification card or driver’s license issued by the department shall include a digital point-of-sale indicator in addition to the designation on the face of the identification card or driver’s license.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
A designation made pursuant to this section may not be used
for any purpose other than the commercial sale of alcohol.

(a)

Upon the conviction of a person for a violation of Section 23152, 23103, as specified in Section 23103.5, 23153, or Section 191.5 of the Penal Code, and the offense occurred with 10 years of a prior separate violation of Section 23152, 23103, as specified in Section 23103.5, 23153, or Section 191.5 of the Penal Code, that resulted in a conviction, or the person has two prior separate violations of Section 23152, 23103, as specified in Section 23103.5, 23153, or Section 191.5 of the Penal Code, or any combination thereof, that resulted in convictions, the court shall issue an order prohibiting the person from purchasing alcohol for a period of 3 to 10 years.

(b)
<html:span class="EnSpace"/>
In imposing an order pursuant to this section, the court shall consider all of
the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
The severity of the offenses.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Prior history of driving under the influence.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Any other relevant factors in aggravation or mitigation.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
A conviction for driving under the influence that does not involve alcohol, may not serve as the basis for an order issued pursuant to this section, unless the court identifies a factual basis for why the order would be appropriate.

No reimbursement is required by this act pursuant to Section 6 of Article XIII
<html:span class="ThinSpace"/>
B of the California Constitution for certain costs that may be incurred by a local agency or school district because, in that regard, this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII
<html:span class="ThinSpace"/>
B of the California Constitution.
</html:p>
<html:p>However, if the Commission on State Mandates determines that this act contains other costs mandated
by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.</html:p>
