<html:p>Under existing law, a person who deprives or violates the personal liberty of another with the intent to obtain forced labor or services, or for the purpose of prostitution or sexual exploitation, is guilty of the crime of human trafficking and subject to imprisonment.</html:p>
<html:p>This bill would, upon appropriation by the Legislature, establish the California Multidisciplinary Alliance to Stop Trafficking Act (California MAST) task force to review collaborative models between governmental and nongovernmental organizations for protecting victims and survivors of trafficking, among other related duties. The task force would be comprised of specified state officials or their designees and specified individuals who have expertise in human trafficking or providing services to
victims of human trafficking, as specified. The bill would require the task force to hold its first meeting no later than July 1, 2027, and would require the task force to meet at least 4 times. The bill would require the task force to, on or before January 1, 2029, and annually thereafter, report its findings and recommendations to the Office of Emergency Services, the Governor, the Attorney General, and the Legislature. The bill would make related findings and declarations.</html:p>

<html:p>The Legislature finds and declares all of the following:</html:p>

(a)
<html:span class="EnSpace"/>
Human Trafficking is the criminal expression of political and economic disenfranchisement and a heinous act that affects individuals of all identities and backgrounds throughout various industries in California. While California has made significant strides in serving victims and survivors of trafficking, additional resources and legislation are needed to position California as a global leader in the antitrafficking movement.

(b)
<html:span class="EnSpace"/>
Human trafficking is a complex crime that requires action on economic and racial justice, workers’ rights, and access to safe housing and health care. In order to comprehensively and holistically address human trafficking, local governments must engage in multidisciplinary collaboration through a survivor-informed lens.

(a)
<html:span class="EnSpace"/>
Upon appropriation by the Legislature, the California Multidisciplinary Alliance to Stop Trafficking Act (California MAST) task force is hereby established to do all of the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Review collaborative models between governmental and nongovernmental organizations for protecting victims and survivors of trafficking.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Map the progress of the state in preventing trafficking, providing comprehensive assistance to victims and survivors of trafficking, and prosecuting persons engaged in trafficking.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Provide recommendations to strengthen state and local efforts to address the issues of human
trafficking, including the role of forced criminality in human trafficking.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
The chair of the task force shall be appointed by the task force. The Office of Emergency Services shall provide staff and support for the task force, to the extent that resources are available.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
The task force shall be comprised of the following representatives or their designees:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
The Attorney General.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
The Secretary of Labor and Workforce Development.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
The Director of Social Services.
</html:p>
<html:p>
(4)
<html:span class="EnSpace"/>
The Director of Health Care Services.
</html:p>
<html:p>
(5)
<html:span class="EnSpace"/>
The Director of Emergency Services.
</html:p>
<html:p>
(6)
<html:span class="EnSpace"/>
The State Public Health Officer.
</html:p>
<html:p>
(7)
<html:span class="EnSpace"/>
The Director of Housing and Community Development.
</html:p>
<html:p>
(8)
<html:span class="EnSpace"/>
The Director of Transportation.
</html:p>
<html:p>
(9)
<html:span class="EnSpace"/>
The Director of Civil Rights.
</html:p>
<html:p>
(10)
<html:span class="EnSpace"/>
A representative from the California Child Welfare Council.
</html:p>
<html:p>
(11)
<html:span class="EnSpace"/>
One representative from the California District Attorneys Association.
</html:p>
<html:p>
(12)
<html:span class="EnSpace"/>
One representative from the California Public Defenders Association.
</html:p>
<html:p>
(13)
<html:span class="EnSpace"/>
The Speaker of the Assembly shall appoint one representative from a human rights organization.
</html:p>
<html:p>
(14)
<html:span class="EnSpace"/>
The Senate Committee on Rules shall appoint one representative from an immigrant rights organization.
</html:p>
<html:p>
(15)
<html:span class="EnSpace"/>
The Governor shall appoint:
</html:p>
<html:p>
(A)
<html:span class="EnSpace"/>
One survivor of labor trafficking.
</html:p>
<html:p>
(B)
<html:span class="EnSpace"/>
One survivor of sex trafficking.
</html:p>
<html:p>
(C)
<html:span class="EnSpace"/>
One survivor of familial trafficking. For the purposes of this section, familial trafficking occurs when a victim is trafficked by a family member or caregiver, or when a minor victim is sold by that minor’s family member or caregiver to a third-party trafficker.

<html:p>
(D)
<html:span class="EnSpace"/>
One representative from a northern California organization that provides services to victims of human trafficking.
</html:p>
<html:p>
(E)
<html:span class="EnSpace"/>
One representative from a southern California organization that provides services to victims of human trafficking.
</html:p>
<html:p>
(F)
<html:span class="EnSpace"/>
One representative from a central California organization that provides services to victims of human trafficking.
</html:p>
<html:p>
(16)
<html:span class="EnSpace"/>
The Attorney General shall appoint three representatives from tribal organizations from northern, central, and southern California.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
Whenever possible, members of the task force shall have experience providing services to trafficked persons or have knowledge of human trafficking issues, including as a survivor of human trafficking.
</html:p>
<html:p>
(e)
<html:span class="EnSpace"/>
The members of the task force shall serve at the pleasure of the respective appointing authority. Reimbursement of
necessary expenses may be provided at the discretion of the respective appointing authority or agency participating in the task force.
</html:p>
<html:p>
(f)
<html:span class="EnSpace"/>
The task force shall meet at least four times. Subcommittees may be formed and meet as necessary. All meetings shall be open to the public. The first meeting of the task force shall be held no later than July 1, 2027.
</html:p>
<html:p>
(g)
<html:span class="EnSpace"/>
On or before January 1, 2029, and on or before each January 1 thereafter, the task force shall report its findings and recommendations to the Office of Emergency Services, the Governor, the Attorney General, and the Legislature. At the request of any member, the report may include minority findings and recommendations.
</html:p>
<html:p>
(h)
<html:span class="EnSpace"/>
For the purposes of this section, “trafficking” shall have the same meaning as in Section 7102(11) of Title 22 of the United States Code.
</html:p>
<html:p>
(i)
<html:span class="EnSpace"/>
All reports to the Legislature made pursuant to this section shall be submitted in compliance with Section 9795 of the Government Code.
