                        <html:p>The Plastic Pollution Prevention and Packaging Producer Responsibility Act covers certain single-use packaging and plastic single-use food service ware, as provided. As part of its comprehensive statutory scheme, the act requires producers of those covered materials to reduce and recycle the covered plastic material and to ensure that covered materials that are offered for sale, distributed, or imported in or into the state on or after January 1, 2032, are recyclable or compostable, as provided. The act prohibits a producer from selling, offering for sale, importing, or distributing covered materials in the state unless the producer is approved to participate in the producer responsibility plan of a producer responsibility organization, as prescribed, for the source reduction, collection, processing, and recycling of covered material, except as provided. The act requires the Department of
                Resources Recycling and Recovery to adopt regulations necessary to implement and enforce the act, as specified. The act also requires the department to report to the Legislature, by January 1 of each odd-numbered year, the department’s progress in implementing the act, as specified.</html:p>
                        <html:p>This bill would instead require the department to make that report to the Legislature by January 2 of each odd-numbered year.</html:p>

                                                                (a)
                                                                <html:span class="EnSpace"/>
                                                                The department shall report to the Legislature every two years its progress in implementing this chapter, including, but not limited to, a description of efforts to adopt regulations under subdivision (a) of Section 42060 and whether PROs are on track to meet the requirements contained in those regulations and the PRO plan. Notwithstanding Section 9795 of the Government Code, the report shall be submitted to the relevant policy and budget committees of the Legislature by January 2 of each odd-numbered year.

                                                                <html:span class="EnSpace"/>
                                                                If a national recycling PRO and producer responsibility plan
                                  is implemented that is similar to the PRO and plan established under this chapter, the department shall review, evaluate, and compare the national PRO and producer responsibility plan and the PRO and plan established under this chapter. Notwithstanding Section 9795 of the Government Code, the department shall submit a report to the relevant policy and budget committees of the Legislature with any related recommended changes to this chapter.
