                        <html:p>Existing law establishes the Office of Small Business Advocate (OSBA) within the Governor’s Office of Business and Economic Development, also known as GO-Biz, to advocate for causes of small business and to provide small businesses with the information they need to survive in the marketplace. Existing law also establishes the California Small Business Technical Assistance Program (SB-TAP) within OSBA, under the direct authority of the Small Business Advocate, for the purpose of assisting small businesses through free or low-cost one-on-one consulting and low-cost training by entering into grant agreements with one or more small business technical assistance centers. Under existing law, OSBA administers the Capital Infusion Program (CIP) pursuant to the SB-TAP, as specified.</html:p>
                        <html:p>This bill would establish the
                         Small Business Resiliency and Innovation Act to provide assistance to small businesses. For this purpose, the bill would appropriate $26,000,000 from the General Fund to the
                         Small Business Resiliency and Innovation Fund, which the bill would create in the State Treasury. The bill would require OSBA to administer the fund and to allocate moneys in the fund to both the CIP and the SB-TAP, and to OSBA for administrative purposes, as provided. The bill would require Go-Biz to submit a report to the Legislature detailing
                         the allocation and expenditure of funds pursuant to these provisions on or before January 1, 2030.</html:p>
                        <html:p>This bill would declare that it is to take effect immediately as an urgency statute.</html:p>

                                                                <html:p>This article shall be known, and may be cited, as the Small Business Resiliency and Innovation Act.</html:p>

                                                                <html:p>The Legislature finds and declares all of the following: </html:p>
                                                                 
                                                                <html:p>
                                                                        (a)
                                                                        <html:span class="EnSpace"/>
                                                                        The Capital Infusion Program (CIP) was created for the purpose of providing small businesses with the necessary resources to pursue strategic initiatives and is administered by the Office of Small Business Advocate within the Governor’s Office of Business and Economic Development (GO-Biz). The CIP has been instrumental in supporting small businesses by providing technical assistance regarding access to capital.

                                                                        <html:span class="EnSpace"/>
                                                                        The Small Business Technical Assistance Program (SB-TAP), which is under the direct authority of the Small Business Advocate, is another critical resource for small businesses, providing essential wraparound technical assistance to support recovery and resilience.
                                                                </html:p>

                                                                        (a)
                                                                        <html:span class="EnSpace"/>
                                                                        The sum of twenty-six million dollars ($26,000,000) is hereby appropriated from the General Fund to the Small Business
                                                  Resilience and Innovation Fund, which is hereby created within the State Treasury. The Office of Small Business Advocate shall administer the fund and shall allocate moneys as follows:
                                                                </html:p>
                                                                <html:p>
                                                                        (1)
                                                                        <html:span class="EnSpace"/>
                                                                        Seven million dollars ($7,000,000) for the Small Business Technical Assistance Program.
                                                                </html:p>
                                                                <html:p>
                                                                        (2)
                                                                        <html:span class="EnSpace"/>
                                                                        Seventeen million dollars ($17,000,000) for the Capital Infusion Program.
                                                                </html:p>
                                                                <html:p>
                                                                        (3)
                                                                        <html:span class="EnSpace"/>
                                                                        Two million dollars ($2,000,000) for staff augmentation, administrative support, program oversight, and accountability activities of the Office of the Small Business Advocate.
                                                                </html:p>
                                                                <html:p>
                                                                        (b)
                                                                        <html:span class="EnSpace"/>
                                                                        Moneys within the fund shall be used solely for the purpose of providing assistance to small businesses.

                                                                        (a)
                                                                        <html:span class="EnSpace"/>
                                                                        GO-Biz shall submit a report to the Legislature on or before January 1, 2030, detailing the allocation and expenditure of funds pursuant to this article.
                                                                </html:p>
                                                                <html:p>
                                                                        (b)
                                                                        <html:span class="EnSpace"/>
                                                                        The report shall include, but not be limited to, all of the following:
                                                                </html:p>
                                                                <html:p>
                                                                        (1)
                                                                        <html:span class="EnSpace"/>
                                                                        The number of businesses assisted.
                                                                </html:p>
                                                                <html:p>
                                                                        (2)
                                                                        <html:span class="EnSpace"/>
                                                                        The types of assistance provided.
                                                                </html:p>
                                                                <html:p>
                                                                        (3)
                                                                        <html:span class="EnSpace"/>
                                                                        An assessment of the impact on business resilience and innovation.
                                                                </html:p>
                                                                <html:p>
                                                                        (c)
                                                                        <html:span class="EnSpace"/>
                                                                        The report shall also include a detailed accounting of the allocation and impact of the funds appropriated to the SB-TAP and CIP.
                                                                </html:p>
                                                                <html:p>
                                                                        (d)
                                                                        <html:span class="EnSpace"/>
                                                                        The report shall be submitted in compliance with Section 9795.

                        <ns0:Content>
                                <html:p>The provisions of this act are severable. If any provision of this act or its application is held invalid, that invalidity shall not affect other provisions or applications that can be given effect without the invalid provision or application.</html:p>

                        <ns0:Num>SEC. 3.</ns0:Num>
                        <ns0:Content>
                                <html:p>This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the California Constitution and shall go into immediate effect. The facts constituting the necessity are:</html:p>
                                <html:p>Small businesses are the primary source of employment and economic stability in communities throughout California, and ongoing economic volatility, rising costs, and constrained credit markets have placed an increasing number of small businesses at risk of closure or relocation. These conditions pose an immediate threat to local employment, household income, and community stability. To allow the state to deploy assistance without delay, stabilize small businesses, preserve jobs, and protect the economic health and safety of communities across California, it is necessary that this act take effect immediately.</html:p>
