Existing law requires each party to a proceeding for dissolution of marriage or legal separation to serve on the other party a preliminary declaration of disclosure of assets, as specified, and a final declaration of disclosure, as specified. In the case of a default judgment, existing law prohibits a petitioner from being required to serve or receive a final declaration of disclosure, but still requires a preliminary declaration of disclosure, except as specified.
</html:p>
<html:p>This bill would provide that both parties are not required to exchange declarations of disclosure in a dissolution of marriage or registered domestic partnership if the parties have an existing enforceable judgment of legal separation that adjudicates or reserves jurisdiction over the division of property.</html:p>

Existing law governs the determination of child custody and visitation in contested proceedings. Existing law requires that custody should be
granted according to the best interest of the child in a specified order of preference. Existing law requires the court to consider, and give due weight to, the wishes of the child in making an order granting or modifying custody or visitation if the child is of sufficient age and capacity to reason so as to form an intelligent preference as to custody or visitation.

Existing law,
the Uniform Fiduciary Income and Principal Act, generally sets forth the powers and duties of a fiduciary of a trust. These powers and duties are related to, among other matters, the allocation of receipts and disbursements between principal and income, making adjustments between principal and income, and converting a trust to a unitrust. In the case of a default judgment, existing law prohibits a petitioner from being required to serve or receive a final declaration of disclosure, but still requires a preliminary declaration of disclosure, except as specified.

In the case of a default judgment, the petitioner may waive the final declaration of disclosure requirements provided in this chapter, and shall not be required to serve a final declaration of disclosure on the respondent nor receive a final declaration of disclosure from the respondent. However, a preliminary declaration of disclosure by the petitioner is required unless the petitioner served the summons and petition by publication or posting pursuant to court order and the respondent has defaulted.

(b)
<html:span class="EnSpace"/>
The petitioner and respondent shall not be required to exchange declarations of disclosure pursuant to Sections 2104 and 2105 in a dissolution of marriage or registered domestic partnership

If a child is of sufficient age and capacity to reason, the court shall consider, and give due weight to, the wishes of the child in making an order granting or modifying custody or visitation.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
In addition to the requirements of subdivision (b) of Section 765 of the Evidence Code, the court shall control the examination of a child witness so as to protect the best interest of the child.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
If the child is 14 years of age or
older and wishes to address the court regarding custody or visitation, the child shall be permitted to do so, unless the court determines that doing so is not in the child’s best interest, in which case, the court shall state its reasons for that finding on the record.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
This section does not prevent a child who is less than 14 years of age from addressing the court regarding custody or visitation, if the court determines that is appropriate pursuant to the child’s best interest.
</html:p>
<html:p>
(e)
<html:span class="EnSpace"/>
If the court precludes the calling of a child as a witness, the court shall provide alternative means of obtaining input from the child and other information regarding the child’s preferences.
</html:p>
<html:p>
(f)
<html:span class="EnSpace"/>
(1)
<html:span class="EnSpace"/>
Except as provided in paragraph (2), the court shall not permit a child addressing the court regarding custody or
visitation to do so in the presence of the parties. The court shall provide an alternative to having the child address the court in the presence of the parties in order to obtain input directly from the child.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Notwithstanding paragraph (1), the court may permit the child addressing the court regarding custody or visitation to do so in the presence of the parties if the court determines that doing so is in the child’s best interest and states its reasons for that finding on the record. In determining the child’s best interest under this paragraph, the court shall consider whether addressing the court regarding custody or visitation in the presence of the parties is likely to be detrimental to the child.

(g)
<html:span class="EnSpace"/>
To assist the court in determining whether the child wishes to express a preference or to provide other input regarding custody or visitation to the court, a minor’s
counsel, an evaluator, an investigator, or a child custody recommending counselor shall indicate to the judge that the child wishes to address the court, or the judge may make that inquiry in the absence of that request. A party or a party’s attorney may also indicate to the judge that the child wishes to address the court or judge.

(h)
<html:span class="EnSpace"/>
If a child informs the minor’s counsel, an evaluator, an investigator, or a child custody recommending counselor at any point that the child has changed their choice with respect to addressing the court, the minor’s counsel, evaluator, investigator, or child custody recommending counselor shall, as soon as feasible, indicate to the judge, the parties or their attorneys, and other professionals serving on the case that the child has changed their preference.
</html:p>
<html:p>
(i)
<html:span class="EnSpace"/>
This section does not require the child to express to the court a preference or to
provide other input regarding custody or visitation.
</html:p>
<html:p>
(j)
<html:span class="EnSpace"/>
The Judicial Council shall, no later than January 1, 2023, develop or amend rules as necessary to implement this section.

To the extent a fiduciary does not account for a receipt from an interest in minerals, water, or other natural resources as a business under Section 16342, the fiduciary shall allocate the receipt in the following manner:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
To income, to the extent received:
</html:p>
<html:p>
(A)
<html:span class="EnSpace"/>
As delay rental or annual rent on a lease.
</html:p>
<html:p>
(B)
<html:span class="EnSpace"/>
As a factor for interest or the equivalent of interest under an agreement creating a production payment.
</html:p>
<html:p>
(C)
<html:span class="EnSpace"/>
On account of an interest in renewable water.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
To principal, if received from a production payment, to the extent subparagraph (B) of paragraph (1) does not apply.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Between income and principal in a reasonable manner, to the extent received:
</html:p>
<html:p>
(A)
<html:span class="EnSpace"/>
On account of an interest in nonrenewable water.
</html:p>
<html:p>
(B)
<html:span class="EnSpace"/>
As a royalty, shut-in-well payment, take-or-pay payment, or bonus.

(C)

From a working interest or any other interest not provided for in subparagraph (A) or (B), or paragraph (1) or (2).

(b)
<html:span class="EnSpace"/>
This section applies to an interest owned or held by a fiduciary whether or not a settlor was extracting minerals, water, or other natural
resources before the fiduciary owned or held the interest.

(c)
<html:span class="EnSpace"/>
An allocation of a receipt under paragraph (3) of subdivision (a) is presumed to be reasonable if the amount allocated to principal is equal to the amount allowed by the Internal Revenue Code of 1986, as amended (Title 26 of the United States Code, as amended), as a deduction for depletion of the interest.

(d)

If a fiduciary owns or holds an interest in minerals, water, or other natural resources before the effective date of this chapter, the fiduciary may allocate receipts from the interest as provided in this section or in the manner used by the fiduciary before the effective date of this chapter. If the fiduciary acquires an interest in minerals, water, or other natural resources on or after the effective date of
this chapter, the fiduciary shall allocate receipts from the interest as provided in this section.
