                        <html:p>Existing law establishes the State Department of Public Health, headed by the State Public Health Officer, and sets forth its powers and duties, including the administration of provisions relating to the prevention and control of communicable diseases. Existing law authorizes the department to take necessary measures to ascertain the nature and prevent the spread of communicable diseases. Existing law prohibits the governing authority of a school or other institution from unconditionally admitting or advancing to the 7th grade level any person as a pupil of any public or private elementary or secondary school, childcare center, day nursery, nursery school, family daycare home, or development center, unless, prior to their admission or advancement to that institution, they have been fully immunized against various communicable diseases, as provided, subject to any specific age criteria.
                Existing law requires the governing authority of a school or other institution, on at least an annual basis, to file a written report on the immunization status of new entrants to the school or institution under their jurisdiction with the department and the local health department at times and on forms prescribed by the department.</html:p>
                        <html:p>This bill would require the department to establish levels of immunization rates needed to prevent the spread of specified communicable diseases. The bill would require the department to establish notification procedures designed to inform designated parties when an immunization rate is determined to fall below the rate established by the department.</html:p>
                        <html:p>Existing law requires the governing board of a school district to annually notify parents or guardians of minor pupils of specified rights and responsibilities of the parent or guardian and of specified school district policies and procedures.</html:p>
                        <html:p>This bill would require the governing authority of a school or other institution, as defined, to notify parents or guardians of enrolled pupils when an immunization rate at that school or institution has fallen below the rate established by the State Department of Public Health. The bill would require the governing authority to follow the procedures established by the State Department of Public Health in distributing this notification to parents or guardians.</html:p>
                        <html:p>By requiring school districts to comply with these requirements, this bill would impose a state-mandated local program.</html:p>
                        <html:p>The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.</html:p>
                        <html:p>This bill would provide that, if the
                Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.</html:p>

                                                                If the governing authority of a school or institution, public or private, receives notice from the State Department of Public Health that an immunization rate at that school or institution has fallen below the rate established pursuant to subdivision (a) of Section 120141 of the Health and Safety Code, the governing authority shall distribute, to the parents or guardians of pupils who are enrolled at that school or institution, a notification in the manner prescribed by subdivision (b) of Section 120141 of the Health and Safety Code.

                                                                For the purposes of this section, “governing authority” has the same meaning as that term is defined in Section 120335 of the Health and Safety Code.

                                                                (a)
                                                                <html:span class="EnSpace"/>
                                                                The State Department of Public Health shall establish the immunization rate necessary to prevent the spread of each communicable disease listed in subdivision (b) of Section 120335.
                                                        </html:p>
                                                        <html:p>
                                                                (b)
                                                                <html:span class="EnSpace"/>
                                                                The department shall establish notification procedures to inform the governing authority of each school or institution included in Section 120335 when an immunization rate for one or more diseases listed in subdivision (b) of Section 120335 is determined to fall below the relevant immunization rate established by the department pursuant to subdivision (a) of this section. The notification shall be written by the department, and shall include the following:

                                                                The immunization rate established
                                  by the department pursuant to subdivision (a) for each disease listed under subdivision (b) of Section 120335.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                The immunization rate for each disease listed under subdivision (b) of Section 120335 that is determined to fall below the rate established by the department pursuant to subdivision (a) of this section.

                                <html:p>If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.</html:p>
