                        <html:p>The California Environmental Quality Act (CEQA) requires a lead agency, as defined, to prepare, or cause to be prepared, and certify the completion of an environmental impact report on a project that it proposes to carry out or approve that may have a significant effect on the environment or to adopt a negative declaration if it finds that the project will not have that effect. CEQA also requires a lead agency to prepare a mitigated negative declaration for a project that may have a significant effect on the environment if revisions in the project would avoid or mitigate that effect and there is no substantial evidence that the project, as revised, would have a significant effect on the environment.</html:p>
                        <html:p>This bill would exempt from CEQA projects for the installation
                         of a wireless telecommunications facility, as defined, or a broadband internet access project, as defined, that is not a small wireless facility, as defined. Because a lead agency would be required to determine whether a project would qualify for this exemption, this bill would impose a state-mandated local program.</html:p>
                        <html:p>The bill would include findings that changes proposed by this bill address a matter of statewide concern rather than a municipal affair and, therefore, apply to all cities, including charter cities.</html:p>
                        <html:p>The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.</html:p>
                        <html:p>This bill would provide that no reimbursement is required by this act for a specified reason.</html:p>

                                                                (a)
                                                                <html:span class="EnSpace"/>
                                                                For purposes of this section, the following definitions apply:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                “Broadband internet access project” means a project to provide mass-market retail service by wire or radio provided to customers in California that provides the capability to transmit data to, and receive data from, all or substantially all internet endpoints, including, but not limited to, a capability that is incidental to, and enable the operation of, the communication service, but excluding dial-up internet access service.

                                                                <html:span class="EnSpace"/>
                                                                “Small wireless facility” means a facility that meets the definition of small wireless facilities as defined in Section 1.6002(l) of Title 47 of the Code of Federal Regulations,
                                                as may be modified or amended by the Federal Communications Commission.

                                                                “Wireless telecommunications facility” means equipment and network components, including, but not limited to, towers, utility poles, transmitters, base stations, and emergency power systems, that are used in the provision of wireless telecommunications services.

                                                                <html:span class="EnSpace"/>
                                                                This division does not apply to a project for the installation of a wireless telecommunications facility, or a broadband internet access project, that is not a small wireless facility.

                                <html:p>The Legislature finds and declares that Section 1 of this act adding Section 21080.75 to the Public Resources Code addresses a matter of statewide concern rather than a municipal affair as that term is used in Section 5 of Article XI of the California Constitution. Therefore, Section 1 of this act applies to all cities, including charter cities.</html:p>

                                <html:p>
                                        No reimbursement is required by this act pursuant to Section 6 of Article XIII
                                        <html:span class="ThinSpace"/>
                                        B of the California Constitution because a local agency or school district has the authority to levy service charges, fees, or assessments sufficient to pay for the program or level of service mandated by this act, within the meaning of Section 17556 of the Government Code.
