<html:p>Existing law generally regulates contracts for health studio services, as defined, including prohibiting those contracts, beginning January 1, 2010, from requiring payment in excess of $4,400, inclusive of initiation or initial membership fees and exclusive of interest or finance charges, by the person receiving the services or use of the facilities. </html:p>
<html:p>This bill would exempt a multiservice health club studio from the above-described provision on payment limitations and would define a “multiservice health club studio” for these purposes.</html:p>

(a)
<html:span class="EnSpace"/>
A contract for health studio services shall not require payment by the person receiving the services or the use of the facilities of a total amount in excess of the amount specified in paragraph (1) or (2).
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
The limit specified in subdivision (a) shall, on and after January 1, 2006, be three thousand dollars ($3,000), inclusive of initiation or initial membership fees and exclusive of interest or finance charges.
</html:p>

(2)
<html:span class="EnSpace"/>
The limit in subdivision (a) shall, on and after January 1, 2010, be four thousand four hundred dollars ($4,400), inclusive of initiation or initial membership fees and exclusive of interest or finance charges.

A contract for health studio services with a multiservice health club studio shall be exempt from the limit specified in subdivision (a).
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
For purposes of paragraph (1), “multiservice health club studio” means a studio that offers three or more of the following amenities:

<html:span class="EnSpace"/>
Digital platform services.
</html:p>
<html:p>
(B)
<html:span class="EnSpace"/>
Individualized training programing.
</html:p>
<html:p>
(C)
<html:span class="EnSpace"/>
Fitness instructor training.
</html:p>
<html:p>
(D)
<html:span class="EnSpace"/>
Group fitness classes.
</html:p>
<html:p>
(E)
<html:span class="EnSpace"/>
Coworking space.
</html:p>
<html:p>
(F)
<html:span class="EnSpace"/>
Childcare.
</html:p>
<html:p>
(G)
<html:span class="EnSpace"/>
Swimming pool.
</html:p>
<html:p>
(H)
<html:span class="EnSpace"/>
Steam room.
