<html:p>The Community Redevelopment Law established redevelopment agencies in each community and granted specified powers to those redevelopment agencies for the purpose of promoting redevelopment in blighted areas. Existing law dissolved those community redevelopment agencies in 2012.</html:p>
<html:p>Other existing law, the Disaster Recovery Reconstruction Act of 1986, authorizes each city, county, or other local subdivision, as provided, to prepare, prior to a disaster, plans and ordinances facilitating the expeditious and orderly recovery and reconstruction of the area in case of a disaster. Existing law authorizes those plans and ordinances to include the authority and proposed organization for establishment of a local reconstruction authority with powers parallel to those of a community redevelopment agency, except as specified.</html:p>
<html:p>This bill would refer to those plans as a disaster recovery plan and would require a city or county that adopts a disaster recovery plan to ensure that its general plan is consistent with, and references, the disaster recovery plan. The bill would require the Office of Land Use and Climate Innovation, in consultation with other specified state and local entities, to assess the recovery and rebuilding needs of jurisdictions across the state and prepare guidance on disaster recovery plans, including model ordinance language, as provided.</html:p>
<html:p>This bill would authorize a city, county, or other local subdivision of the state to adopt an ordinance prior to a disaster, which could be invoked as soon as possible after a disaster, that would establish a local reconstruction agency, rather than a reconstruction authority, to coordinate disaster recovery efforts in the areas impacted by the disaster. The bill would authorize the ordinance to
grant the reconstruction agency specified powers, similar to those previously authorized for a community redevelopment agency, including, among other powers, to sue and be sued, to make and execute contracts, to issue or sell bonds, and to accept financial assistance from any public or private source. The bill would also authorize a reconstruction agency to accept, through a dedication by the city, county, or other taxing entity, incremental tax revenues derived from local sales and use taxes or from transactions and use taxes, as provided.</html:p>

(a)
<html:span class="EnSpace"/>
Each city, county, or other local subdivision of the state, in conjunction with planning activities authorized under Article 5 (commencing with Section 65300) of Chapter 3 of Division 1 of Title 7 and Article 10 (commencing with Section 8610) of Chapter 7, may prepare, prior to a disaster, a disaster recovery
plan and ordinances facilitating the expeditious and orderly recovery and reconstruction of the area under its jurisdiction, should a disaster occur. The plan and ordinances may include any of the following:

(1)
<html:span class="EnSpace"/>
An evaluation of the vulnerability of specific areas under its jurisdiction to damage from a potential disaster, together with streamlined procedures for the appropriate modification of existing general plans or zoning ordinances
affecting those areas after a disaster.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
A contingency plan of action and organization for short-term and long-term recovery and reconstruction to be instituted after a disaster.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
An ordinance, to be adopted prior to the disaster, which could be invoked as soon as possible after the event and which would provide necessary local
authorization for activities designated under
paragraphs (1) and (2).

(b)
<html:span class="EnSpace"/>
The plan and ordinances may include the authority and proposed organization for establishment of a local reconstruction
agency, as provided in Section 8877.7.

(c)
<html:span class="EnSpace"/>
The plan and organizational arrangements may be made separately or jointly by formal cooperative arrangements with other local entities, including climate resilience districts and enhanced infrastructure financing districts that operate within a city, county, or other local subdivision of the state.

(d)
<html:span class="EnSpace"/>
A city or county shall ensure that its general plan is consistent with, and references, any disaster recovery plan adopted pursuant to subdivision (a).

(e)
<html:span class="EnSpace"/>
To assist local jurisdictions in the preparation of the plan and ordinances required pursuant to subdivision (a), the Office of Land Use and Climate Innovation shall, in consultation with the Office of Emergency Services and, where appropriate, regional councils of governments, assess the recovery and rebuilding needs of jurisdictions across the state and prepare guidance on disaster recovery plans, including model ordinance language to satisfy the requirement in paragraph (3) of subdivision (a). The guidance and model ordinance language shall be designed to be adaptable by jurisdictions based on geographic location, governmental structure, capacity, and any other factors the Office of Land Use and Climate Innovation deems
relevant.

<html:p>A city, county, or other local subdivision of the state may adopt an ordinance prior to a disaster, which could be invoked as soon as possible after a disaster, that would establish a local reconstruction agency to coordinate disaster recovery efforts in the areas impacted by the disaster. The ordinance may grant the reconstruction agency the power to engage in any of the following activities:</html:p>

(a)
<html:span class="EnSpace"/>
Sue and be sued.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
Adopt a seal.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
Make and execute contracts and other instruments necessary or convenient to the exercise of its powers.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
Make, amend, and repeal bylaws and
regulations not inconsistent with, and to carry out, its powers and purposes.
</html:p>
<html:p>
(e)
<html:span class="EnSpace"/>
Within its area of operation, purchase, lease, obtain option upon, acquire by gift, grant, bequest, devise, eminent domain, or otherwise, any real or personal property, any interest in property, and any improvements on it, including repurchase of developed property previously owned by the reconstruction agency.
</html:p>
<html:p>
(f)
<html:span class="EnSpace"/>
Dispose of assets, including by sale or lease.
</html:p>
<html:p>
(g)
<html:span class="EnSpace"/>
Issue or sell bonds.
</html:p>
<html:p>
(h)
<html:span class="EnSpace"/>
Incur and restructure debt.
</html:p>
<html:p>
(i)
<html:span class="EnSpace"/>
Accept financial assistance from any public or private source.
</html:p>
<html:p>
(j)
<html:span class="EnSpace"/>
Accept any other assistance from the state or federal
government or any public or private source for any project within its area of operation or for the reconstruction agency’s activities, powers, and duties.
</html:p>
<html:p>
(k)
<html:span class="EnSpace"/>
Accept, through a dedication by the city, county, or other taxing entity, incremental tax revenues derived from local sales and use taxes imposed pursuant to the Bradley-Burns Uniform Local Sales and Use Tax Law (Part 1.5 (commencing with Section 7200) of Division 2 of the Revenue and Taxation Code) or tax revenues derived from transactions and use taxes imposed in accordance with the Transactions and Use Tax Law (Part 1.6 (commencing with Section 7251) of Division 2 of the Revenue and Taxation Code) and utilize these revenues to finance or assist activities related to recovery from the disaster, including, but not limited to, administrative costs associated with the operation of the reconstruction agency. A city, county, or other taxing entity that elects to dedicate incremental sales
and use tax revenue or transactions and use tax revenue to a reconstruction agency, as described in this subdivision, shall include in the ordinance establishing the reconstruction agency both of the following:

(1)
<html:span class="EnSpace"/>
The procedure by which the city, county, or other affected taxing entities will calculate the revenues derived from sales and use taxes and transactions and use taxes to be allocated to the reconstruction agency.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
The decision process by which the city, county, or other affected taxing entity will determine the amount that will be dedicated to the reconstruction agency.
</html:p>
<html:p>
(l)
<html:span class="EnSpace"/>
Execute trust deeds or mortgages on properties owned or acquired.
</html:p>
<html:p>
(m)
<html:span class="EnSpace"/>
Prepare or cause to be prepared and carry out plans for the improvement, rehabilitation, recovery,
and redevelopment of disaster-impacted areas, which may include the following activities:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Holding hearings and conducting examinations, investigations, and other negotiations.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Consulting with the local planning commission and the project area committee, if applicable, in preparing plans.
</html:p>
<html:p>
(n)
<html:span class="EnSpace"/>
Make loans or provide funds or financial assistance to residents and businesses consistent with its purposes.
</html:p>
<html:p>
(o)
<html:span class="EnSpace"/>
Within its area of operation, for purposes of disaster recovery, insure or provide for the insurance of any operations of the reconstruction agency against risks or hazards.
</html:p>
<html:p>
(p)
<html:span class="EnSpace"/>
Select, appoint, and employ permanent and temporary officers, agents, counsel, and employees as it
requires, and determine their qualifications, duties, benefits, and compensation, subject only to the conditions and restrictions imposed by the legislative body on the expenditure or encumbrance of the budgetary funds appropriated to the reconstruction agency.

<html:p>
(q)
<html:span class="EnSpace"/>
Contract with other governmental entities for the furnishing of any necessary staff services associated with or required by the reconstruction agency that could be performed by the staff of that other governmental entity.
</html:p>
<html:p>
(r)
<html:span class="EnSpace"/>
Obtain, hire, purchase, or rent office space, equipment, supplies, insurance, or services.
</html:p>
<html:p>
(s)
<html:span class="EnSpace"/>
Authorize and pay the travel expenses of reconstruction agency members, officers, agents, counsel, and employees engaging in official business.
</html:p>
<html:p>
(t)
<html:span class="EnSpace"/>
Disseminate information
related to disaster recovery.
</html:p>
<html:p>
(u)
<html:span class="EnSpace"/>
Prepare applications for various governmental programs and grants relating to disaster recovery, housing, and community development, and plan and carry out those programs and grants within its authority.
