                        <html:p>Existing law generally provides for the regulation of law enforcement agencies and requires specified law enforcement agencies to maintain policies on, among other things, use of force, hate crimes, and gun violence restraining orders. Existing law requires the Commission on Peace Officer Standards and Training to establish and keep updated a field training officer course relating to competencies of the field training program and police training program that addresses how to interact with persons with certain conditions.</html:p>
                        <html:p>Under existing law, the Tom Bane Civil Rights Act, if a person or persons, whether or not acting under color of law, interferes or attempts to interfere, by threats, intimidation, or coercion, with the exercise or enjoyment by any individual or individuals of rights secured by the Constitution or laws of the United States, or of
                the rights secured by the Constitution or laws of this state, the Attorney General, or any district attorney or city attorney, is authorized to bring a civil action for injunctive and other appropriate equitable relief in the name of the people of the State of California, in order to protect the exercise or enjoyment of the right or rights secured. Under the act, an individual may also institute and prosecute in their own name and on their own behalf a civil action for damages, as described, for any resulting interference or attempt at interference of the individual’s exercise or enjoyment of rights secured by the Constitution or laws of the United States or this state. The act authorizes the court to award the petitioner or plaintiff reasonable attorney’s fees in addition to any damages, injunction, or other equitable relief awarded in these civil actions.</html:p>
                        <html:p>This bill would require law enforcement, as defined, to ensure that a medical professional is allowed
                reasonable access to provide emergency care once the scene of an incident is secure. The bill would make it unlawful for law enforcement to deny, delay, obstruct, or fail to facilitate access to a medical evaluation or treatment for an individual in custody or detention, or under law enforcement control, as specified. The bill would require law enforcement, if disclosure would not compromise an ongoing investigation or officer safety, to provide documentation, as specified, identifying the basis for denying or delaying access to medical treatment to specified entities within 72 hours of the incident, as specified. The bill would authorize various punishments against a law enforcement officer who violates those provisions including, among other things, administrative discipline and criminal prosecution. By creating a new crime and by increasing the duties on local law enforcement relating to reporting, the bill would impose a state-mandated local program.</html:p>
                        <html:p>The
                California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.</html:p>
                        <html:p>This bill would provide that with regard to certain mandates no reimbursement is required by this act for a specified reason.</html:p>
                        <html:p>With regard to any other mandates, this bill would provide that, if the Commission on State Mandates determines that the bill contains costs so mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.</html:p>

                <ns0:Preamble>The people of the State of California do enact as follows:</ns0:Preamble>

                                                        <html:p>
                                                                (a)
                                                                <html:span class="EnSpace"/>
                                                                For the purposes of this section, the following definitions apply:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                “Law enforcement” means any federal, state, or local law enforcement, acting under the color of the law, to the extent permitted by federal law.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                “Medical professional” means an individual licensed or certified to provide emergency medical care.
                                                        </html:p>
                                                        <html:p>
                                                                (3)
                                                                <html:span class="EnSpace"/>
                                                                “Secure” means that law enforcement has determined that no imminent threat to public safety exists based on a documented risk assessment.
                                                        </html:p>
                                                        <html:p>
                                                                (b)
                                                                <html:span class="EnSpace"/>
                                                                If law enforcement has secured a scene following an injury causing incident, officers
                                  shall ensure that a medical professional is allowed reasonable access to provide emergency care once the scene is secure.
                                                        </html:p>
                                                        <html:p>
                                                                (c)
                                                                <html:span class="EnSpace"/>
                                                                Once the scene is secure, law enforcement shall not unreasonably deny access to a medical professional who identifies themself and presents credentials.
                                                        </html:p>
                                                        <html:p>
                                                                (d)
                                                                <html:span class="EnSpace"/>
                                                                Law enforcement shall coordinate with emergency medical services to prioritize rapid patient assessment and lifesaving interventions, including, but not limited to, requesting emergency medical services immediately once the scene is secured after law enforcement has determined, or reasonably should have determined, that a person has sustained a critical injury.
                                                        </html:p>

                                                                (e)
                                                                <html:span class="EnSpace"/>
                                                                It shall be unlawful for any law enforcement officer to deny, delay, obstruct, or fail to facilitate access to medical evaluation or treatment for an individual in custody,
                                  detention, or under law enforcement control if a medical professional is present or has been requested, without proper written justification based on a specific and articulable safety necessity.
                                                        </html:p>

                                                                <html:span class="EnSpace"/>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                To the extent disclosure does not compromise an ongoing criminal investigation or officer safety, if access is denied or delayed when a medical professional is present, law enforcement shall provide written documentation indicating the basis for denial within 72 hours of the incident that meets all of the following requirements:
                                                        </html:p>
                                                        <html:p>
                                                                (A)
                                                                <html:span class="EnSpace"/>
                                                                States the basis for denial or delay.
                                                        </html:p>
                                                        <html:p>
                                                                (B)
                                                                <html:span class="EnSpace"/>
                                                                Identifies the specific threat relied upon.
                                                        </html:p>
                                                        <html:p>
                                                                (C)
                                                                <html:span class="EnSpace"/>
                                                                Provides a detailed incident narrative that includes, but is not limited to, time of the incident, location of
                                  the incident, and personnel involved in the incident.
                                                        </html:p>
                                                        <html:p>
                                                                (D)
                                                                <html:span class="EnSpace"/>
                                                                Includes any available supporting evidence, including body-worn camera footage, radio transmissions, or written incident reports.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                Reporting pursuant to this subdivision shall be provided to the relevant civilian oversight body responsible for reviewing law enforcement conduct, the Office of the Inspector General, or the Attorney General.
                                                        </html:p>
                                                        <html:p>
                                                                (g)
                                                                <html:span class="EnSpace"/>
                                                                A law enforcement officer who knowingly and negligently fails to comply with their duty to facilitate medical assistance or the documentation requirements of paragraph (b), (e), or (f), or who provides materially false, misleading, or incomplete information in a report, shall be deemed to have violated a statutory duty of care owed to the individual in custody.
                                                        </html:p>

                                                                (h)
                                                                <html:span class="EnSpace"/>
                                                                A law enforcement officer who violates subdivision (b), (e), or (f) may be subject to the following:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                Administrative discipline, including suspension or termination.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                Civil liability.
                                                        </html:p>
                                                        <html:p>
                                                                (3)
                                                                <html:span class="EnSpace"/>
                                                                Criminal proceedings, including prosecution, if the conduct constitutes a criminal offense.
                                                        </html:p>
                                                        <html:p>
                                                                (i)
                                                                <html:span class="EnSpace"/>
                                                                The Commission on Peace Officer Standards and Training shall incorporate guidance on facilitating emergency medical access, scene security standards, and coordination with emergency medical services into law enforcement training curricula.
                                                        </html:p>

                                <html:p>
                                        No reimbursement is required by this act pursuant to Section 6 of Article XIII
                                        <html:span class="ThinSpace"/>
                                        B of the California Constitution for certain costs that may be incurred by a local agency or school district because, in that regard, this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII
                                        <html:span class="ThinSpace"/>
                                        B of the California Constitution.
                                </html:p>
                                <html:p>However, if the Commission on State Mandates determines that this act contains other costs mandated by the state, reimbursement to local agencies and school districts for those costs shall
                  be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.</html:p>
