<html:p>Existing law allows for an application authorizing the interception of a wire or electronic communication to be made by certain prosecutors to a judge of a superior court. Existing law authorizes the judge to enter an ex parte order authorizing the interception of wire or electronic communications and requires each of those orders to include specific information, including, among other things, the identity of the agency authorized to intercept the communications and of the person making the application.</html:p>
<html:p>This bill would make technical, nonsubstantive changes to those provisions.</html:p>

<html:p>Each order authorizing the interception of any wire or electronic communication shall specify all of the following:</html:p>
<html:p>
(a)
<html:span class="EnSpace"/>
The identity, if known, of the person whose communications are to be intercepted or, if the identity is not known, then that information relating to the person’s identity known to the applicant.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
The nature and location of the communication facilities as to which, or the place where, authority to intercept is granted.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
A particular description of the type of communication sought to be intercepted, and a statement of the illegal activities to which
the communication sought to be intercepted relates.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
The identity of the agency authorized to intercept the communications and of the person making the application.
</html:p>
<html:p>
(e)
<html:span class="EnSpace"/>
The period of time during which the interception is authorized including a statement as to whether or not the interception shall automatically terminate when the described communication has been first obtained.
