<html:p>Existing law assigns to the Superintendent of Public Instruction numerous duties related to the State Board of Education and to the management of the State Department of Education relating to the governance of the public elementary and secondary schools in the state.</html:p>
<html:p>This bill would assign specified duties of the Superintendent of Public Instruction to an undesignated Secretary of Education, including, among others, to superintend the schools of this state and to execute the policies that have been decided upon by the state board.</html:p>

<html:p>The Secretary of Education shall:</html:p>
<html:p>
(a)
<html:span class="EnSpace"/>
Superintend the schools of this state.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
Prepare, have printed, and furnish to teachers and to all officers charged with the administration of the laws relating to the public schools the blank forms and books necessary to the discharge of their duties, including blank teachers’ certificates to be used by county and city and county boards of education.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
Authenticate with
their official seal all drafts or orders drawn by them, and all papers and writings issued from their office.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
Have bound, at the state bindery, all valuable school reports, journals, and documents in the Secretary of Education’s office, or received by
them.
</html:p>
<html:p>
(e)
<html:span class="EnSpace"/>
Deliver over, at the expiration of their term of office, on demand, to their successor, all property, books, documents, maps, records, reports, and other papers belonging to the Secretary of Education’s office, or which may have been received by
them for the use of their office.
</html:p>
<html:p>
(f)
<html:span class="EnSpace"/>
Designate and appoint, or terminate the designation and appointment of, any officer or employee of the department to have the powers and liabilities of a deputy, including designation pursuant to Section 7.9 of the Government Code, which appointment and termination of appointment shall be effective when filed in writing in the office of the Secretary of State.

(g)
<html:span class="EnSpace"/>
Annually inform the governing boards of school districts, in a manner
prescribed, of the provisions of Section 60510.5.
