<html:p>Existing law creates the Department of Insurance to regulate the business of insurance. Existing law generally regulates residential property insurance, including homeowners’ insurance. Existing law establishes the California FAIR Plan Association, which is a joint reinsurance association where all insurers licensed to write basic property insurance participate to administer a program for the equitable apportionment of basic property insurance for persons who are unable to obtain that coverage through normal channels. Existing law requires the department to post various reports, enforcement notifications, and pleadings to the department’s internet website.</html:p>
<html:p>This bill would require the department to update its internet website to make it more user-friendly and accessible. The bill would require the update to include regularly posting data,
including, but not limited to, home insurance market data, admitted market data, California FAIR Plan data, nonadmitted market data, profitability data, department performance data, and clear instructions for insurance brokers and agents to find and contact specified surplus line brokers. The bill would also require the information be available in an easily accessible and searchable format, including a downloadable spreadsheet.</html:p>

(a)
<html:span class="EnSpace"/>
The department shall update its internet website to make it more user-friendly and accessible. The update shall include regularly posting data regarding the state of the home insurance market and key indicators of the department’s performance regulating the market. The information shall be available in an easily accessible and searchable format. The data shall also be made available in a downloadable spreadsheet.

(b)

The data uploaded to the department’s internet website shall include all of the following:

<html:p>
(1)
<html:span class="EnSpace"/>
Home insurance market data, including the number of homeowners policies by insurer type, total written premium, total written exposure, average written premium by year
and county, and the number of new and renewed home insurance policies by year, type of insurer, and county.

<html:p>
(2)
<html:span class="EnSpace"/>
Admitted market data, including the number of companies writing homeowner policies by year and market share and the number of nonrenewals and cancellations by year, county, and initiator.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
California FAIR Plan data, including the number of nonrenewals and cancellations by year, county, and initiator and the number of difference in condition policies, by year.

<html:p>
(4)
<html:span class="EnSpace"/>
Nonadmitted market data, including the total number of state-licensed surplus line brokers by year and the total number of approved surplus line insurers by year and home jurisdiction.
</html:p>
<html:p>
(5)
<html:span class="EnSpace"/>
Profitability data, including written premium, earned premium, loss incurred, market share,
and loss ratio by insurer and year.

<html:span class="EnSpace"/>
Department performance data, including the number of filings made by year, by insurer, and the amount requested, status of each filing by processing time in number of days, and the number and length of interventions.

Clear instructions for insurance brokers and agents on how to lookup and contact the licensed surplus line brokers contained in the List of Approved Surplus Line Insurers located on the department’s internet website.
