                <ns0:Title>An act to add Section 4564 to the Government Code, relating to day care centers.</ns0:Title>

                        <html:p>Existing law, the California Child Day Care Facilities Act, sets forth requirements for licensure as a day care center.</html:p>
                        <html:p>This bill would require, on and after January 1, 2027, when the state constructs, acquires, or receives as a gift any office building that can accommodate state employees, or when additions, alterations, or repairs are made to any existing state-owned office building, priority to be given to licensed child care providers, as defined, that seek to contract with the Director of General Services (director) to use a part of the space as a day care center, as defined. The bill would subject the use of the space as a day care center to terms and conditions set forth by the director, including as to cost. The bill would prohibit the state from charging
                rent to licensed child care providers using the space as a day care center, as specified, if the provider is a nonprofit entity and accepts subsidies.</html:p>
                        <html:p>This bill would authorize the director to secure other space not attached to a state-owned office building for use as a day care center if funds are made available for those purposes and the director determines one of certain conditions exist. The bill would also authorize existing state-owned office buildings to be retrofitted to accommodate a day care center at the director’s discretion, to the extent that state funds are made available for those purposes. The bill would set forth priority for enrollment of children in day care centers established pursuant to the bill’s provisions.</html:p>
                        <html:p>This bill would require compliance with local and state safety building codes for day care centers in state-owned office buildings. The bill would exclude from the bill’s provisions office
                buildings used or owned by the state that provide care or 24-hour residential care for patients, inmates, or wards of the state.</html:p>
                        <html:p>The bill would make related findings and declarations, including findings and declarations related to a gift of public funds.</html:p>

                                                                (a)
                                                                <html:span class="EnSpace"/>
                                                                The Legislature finds and declares all of the following:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                There is a substantial need to provide quality child care facilities for state employees and the communities surrounding state-owned buildings.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                Many California families struggle to find the quality and affordable care they need.
                                                        </html:p>
                                                        <html:p>
                                                                (3)
                                                                <html:span class="EnSpace"/>
                                                                State-owned buildings provide a significant opportunity to provide new space for licensed child care providers in locations that are in proximity to where Californians work and live.
                                                        </html:p>
                                                        <html:p>
                                                                (b)
                                                                <html:span class="EnSpace"/>
                                                                On and after January 1, 2027, when the state constructs, acquires, or
                                  receives as a gift any office building that can accommodate state employees, or when additions, alterations, or repairs are made to any existing state-owned office building, priority shall be given to licensed child care providers that seek to contract with the Director of General Services to use a part of the space as a day care center.

                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                Use of a space described in subdivision (b) by a licensed child care provider as a day care center shall be subject to terms and conditions set forth by the Director of General Services, including the cost set by the director under paragraph (2).
                                                        </html:p>

                                                                (A)
                                                                <html:span class="EnSpace"/>
                                                                The space shall be made available at a rate to be established by the Director of General Services based upon the actual cost to the state, the average cost of state-owned space in the area, or the statewide average cost of state-owned space,
                                  whichever is less. However, if the director determines that a lower rent must be charged to ensure the viability of a day care center, the director may charge a lower rate.
                                                        </html:p>

                                                                (B)
                                                                <html:span class="EnSpace"/>
                                                                Notwithstanding subparagraph (A), the state shall not charge rent to licensed child care providers that use the space as a day care center pursuant to this section if the provider is a nonprofit entity and accepts subsidies.

                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                Space designed within a state-owned office building for the day care center shall comply with the prevailing local and state safety building codes for day care centers.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                The indoor activity space and outdoor activity space shall comply with the requirements in Title 22 of the California Code of Regulations.
                                                        </html:p>
                                                        <html:p>
                                                                (e)
                                                                <html:span class="EnSpace"/>
                                                                The Director of
                                  General Services may also secure space, that is not subject to subdivision (b) and that is not attached to a state-owned office building, for use as a day care center run by a licensed child care provider if funds are made available for those purposes and the director determines that any of the following conditions exist:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                All other physical requirements controlling the development of the day care center within the state-owned office building cannot be utilized.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                It is more cost-efficient for the state to provide for equivalent day care centers within a reasonable distance of the state-owned office building.
                                                        </html:p>
                                                        <html:p>
                                                                (3)
                                                                <html:span class="EnSpace"/>
                                                                Locating the day care center within a reasonable distance from the state-owned office building would provide an enhanced facility for the children or would mitigate security concerns.
                                                        </html:p>
                                                        <html:p>
                                                                (f)
                                                                <html:span class="EnSpace"/>
                                                                Existing state-owned office buildings may also be retrofitted to accommodate a day care center at the discretion of the Director of General Services, to the extent that state funds are made available for these purposes.
                                                        </html:p>
                                                        <html:p>
                                                                (g)
                                                                <html:span class="EnSpace"/>
                                                                Priority for enrollment of children in day care centers established pursuant to this section shall be in the following order:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                State employees who work in the state-owned office building.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                All other state employees.
                                                        </html:p>
                                                        <html:p>
                                                                (3)
                                                                <html:span class="EnSpace"/>
                                                                Members of the community with a primary residence within a five mile radius of the state office building.
                                                        </html:p>
                                                        <html:p>
                                                                (h)
                                                                <html:span class="EnSpace"/>
                                                                This section shall not apply to any office buildings used or owned by
                                  the state that provide care or 24-hour residential care for patients, inmates, or wards of the state, such as state hospitals and correctional facilities.
                                                        </html:p>
                                                        <html:p>
                                                                (i)
                                                                <html:span class="EnSpace"/>
                                                                For purposes of this section, the following definitions shall apply:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                “Day care center” has the same meaning as set forth in Section 1596.76 of the Health and Safety Code.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                “Licensed child care provider” means a person who operates a day care center and is licensed pursuant to Chapter 3.5 (commencing with Section 1596.90) of Division 2 of the Health and Safety Code.

                        <ns0:Content>
                                <html:p>The Legislature finds and declares that Section 4564 of the Government Code, as added by this act, is necessary for the public purpose of assisting Californian families who are struggling to find quality and affordable child care, and do not constitute a gift of public funds within the meaning of Section 6 of Article XVI of the California Constitution.</html:p>
