<html:p>The Public Utilities Act vests the Public Utilities Commission with regulatory authority over public utilities, including electrical and gas corporations. Existing law authorizes the commission, after a hearing, to make and serve an order directing additions, extensions, repairs, improvements, or other changes to be made to an existing plant, equipment, apparatus, facilities, or other physical property of a public utility, if it makes certain findings. Existing law requires that the commission, as a basis for making any such order relating to the location of structures, give consideration to, and include in its order, findings on community values, recreation and park areas, historical and aesthetic values, and, except as specified, influence on the environment.</html:p>
<html:p>This bill would require that the commission, as a basis for making an order relating to
the location of structures, also give consideration to, and include in its order, findings on anticipated maintenance costs.</html:p>
<html:p>Under existing law, a violation of any order, decision, rule, direction, demand, or requirement of the commission is a crime.</html:p>
<html:p>Because a violation of a commission action implementing this bill’s requirements would be a crime, the bill would impose a state-mandated local program.</html:p>
<html:p>The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.</html:p>
<html:p>This bill would provide that no reimbursement is required by this act for a specified reason.</html:p>

<html:p>The commission, as a basis for making any order pursuant to Section 762 relating to the location of structures, shall give consideration to, and include in its order findings on, the following factors:</html:p>
<html:p>
(a)
<html:span class="EnSpace"/>
Community values.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
Recreational and park areas.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
Historical and aesthetic values.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
Influence on the environment, except that in the case of any structure located in another state that will be subject to environmental impact review pursuant to the National Environmental Policy Act of 1969 (Chapter 55 (commencing with Section 4321) of Title 42 of the United States Code) or similar state laws in the other state, the commission shall not consider influence on the environment unless any emissions or discharges therefrom would have a significant influence on the environment of this state.

B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII
