<ns0:Title> An act to add Article 15 (commencing with Section 49591) to Chapter 9 of Part 27 of Division 4 of Title 2 of the Education Code, relating to pupil health, and making an appropriation therefor.</ns0:Title>

<html:p>Existing law requires the governing board of a school district to give diligent care to the health and physical development of pupils and authorizes the governing board of a school district to employ properly certified persons for this purpose. Existing law requires a school of a school district or county office of education and a charter school to notify pupils and parents or guardians of pupils no less than twice during the school year on how to initiate access to available pupil mental health services on campus or in the community, or both, as provided.</html:p>
<html:p>This bill would require the State Department of Education to establish a statewide Tier 1 Social and Emotional Learning, behavioral health, and restorative justice education program for pupils in kindergarten and any of grades 1 to 12, inclusive, as provided. The bill would require a school
district, county office of education, or charter school to implement the program with guidance issued by the department and supported using funds appropriated for the Children and Youth Behavioral Health Initiative, as specified. By changing the purposes for which previously appropriated funds may be used, this bill would make an appropriation.</html:p>
<html:p>By imposing additional duties on local educational agencies, this bill would impose a state-mandated local program.</html:p>
<html:p>The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.</html:p>
<html:p>This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory
provisions noted above.</html:p>

<ns0:Preamble>The people of the State of California do enact as follows:</ns0:Preamble>

<ns0:Num>SECTION 1.</ns0:Num>

<html:p>The Legislature finds and declares all of the following:</html:p>
<html:p>
(a)
<html:span class="EnSpace"/>
Social and emotional learning is a critical component of student well-being, academic success, and long-term public safety.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
The California Department of Education has established “California’s Social and Emotional Learning Guiding Principles” that emphasize trauma-informed, evidence-based approaches to teaching and learning.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
Tier 1 supports, including universal prevention, early intervention, and positive behavioral strategies, are effective in promoting mental health and reducing later system involvement.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
Schools are uniquely positioned to provide consistent, preventive supports to children and youth before mental health challenges escalate.
</html:p>
<html:p>
(e)
<html:span class="EnSpace"/>
The Legislature has already appropriated funds to support children and youth behavioral health initiatives and intends for those funds to be used efficiently and equitably.

<ns0:Content>
<html:p>It is the intent of the Legislature to do all of the following:</html:p>
<html:p>
(a)
<html:span class="EnSpace"/>
Establish a statewide Tier 1 Social and Emotional Learning framework aligned with existing California Department of Education standards.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
Promote early intervention and prevention of behavioral health challenges.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
Reduce disciplinary disparities and long-term justice system involvement.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
Use existing behavioral health funding without creating a new entitlement.
</html:p>

<html:p>
(a)
<html:span class="EnSpace"/>
The department shall establish a statewide Tier 1 Social and Emotional Learning, behavioral health, and restorative justice education program for pupils in kindergarten and any of grades 1 to 12, inclusive.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
The program established in subdivision (a) shall be aligned with the department’s “California’s Social and Emotional Learning Guiding Principles” and shall incorporate evidence-based, trauma-informed practices.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
Tier 1 supports may include, but are not limited to, all of the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Social and emotional learning instruction.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Coping and stress-management skills.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Positive behavior and relationship development.
</html:p>
<html:p>
(4)
<html:span class="EnSpace"/>
Restorative justice practices.
</html:p>
<html:p>
(5)
<html:span class="EnSpace"/>
Early identification and referral pathways.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
A school district, county office of education, or charter school shall implement the program established in subdivision (a) consistent with guidance issued by the department, subject to available funding and legislative approval.

(e)
<html:span class="EnSpace"/>
Implementation of the program established in subdivision (a) shall be supported using funds appropriated for the Children and Youth Behavioral Health Initiative pursuant to the Budget Act of 2025.
