<html:p>Federal law establishes United States coins and currency as legal tender for all debts, public charges, taxes, and dues, and authorizes the Secretary of the Treasury to mint and issue a one-cent coin. Existing state law generally regulates the use of credit cards, debit cards, gift certificates, and other forms of payment for goods and services in this state.</html:p>
<html:p>This bill would enact the Californians for Common Cents Act to require a merchant, for a transaction paid with legal tender, to determine the total price of goods or services by rounding to the nearest amount divisible by five, as specified. The bill would define “legal tender” as all coins and currencies of the United States. The bill would authorize the Commissioner of Financial Protection and Innovation to promulgate regulations to implement the act, including regulating exemptions or
exclusions from the act’s requirements.</html:p>

<html:p>This title shall be known, and may be cited as, the “Californians for Common Cents Act.”</html:p>

<html:p>For the purposes of this title, the following terms shall have the following meanings:</html:p>
<html:p>
(a)
<html:span class="EnSpace"/>
“Merchant” means any person, corporation, or partnership engaged in the business of the sale of goods or services engaging in face-to-face, in-person sales.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
“Legal tender” means all coins and currencies of the United States.

(a)
<html:span class="EnSpace"/>
Notwithstanding any other law and except as provided in subdivision (b), a merchant doing business in this state shall determine the total price of goods or services in the following manner:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Calculate the sum of goods and services, making any subtraction for a discount or deduction and then any addition for applicable taxes, including sales and use tax, in accordance with all applicable law.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
(A)
<html:span class="EnSpace"/>
If a mill, one cent, two cents, six cents, or seven cents is at the end of the resulting sum from paragraph (1), that sum shall be rounded down to the nearest amount divisible by five for those individuals seeking to pay with legal tender.

(B)
<html:span class="EnSpace"/>
If three cents, four cents, eight cents, or nine cents is at the end of the resulting sum from paragraph (1), that sum shall be rounded up to the nearest amount divisible by five for those individuals paying with legal tender.

(b)
<html:span class="EnSpace"/>
The total price of goods or services shall not be calculated pursuant to subdivision (a) for the following transactions:
</html:p>

(1)
<html:span class="EnSpace"/>
The sum of goods and services is four cents or less.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Payment is made by any demand or negotiable instrument, electronic fund transfer, money order, credit card, debit card, electronic payment, or other like instrument.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
Any tax imposed by the state or a local government shall not apply to gains or losses resulting from
rounding.
