<html:p>Existing law generally prohibits a person from possessing, importing, shipping, or transporting in the state, or from placing, planting, or causing to be placed or planted in any water within the state, invasive mussels and authorizes the Director of Fish and Wildlife or the director’s designee to engage in various enforcement activities with regard to invasive mussels, as provided. Existing law requires specified entities that own or manage a reservoir, as defined, where certain activities are permitted to monitor and prevent the introduction of invasive mussel species, as specified, and requires any entity that discovers invasive mussels in the state to report the discovery immediately to the department.</html:p>
<html:p>This bill would provide that it is the intent of the Legislature to enact subsequent legislation to, among other things, address and prevent
the spread of aquatic invasive species, including, but not limited to, the golden mussel, in California’s waterbodies and water infrastructure systems. The bill would also make various findings and declarations relating to aquatic invasive species.</html:p>

<ns0:Preamble>The people of the State of California do enact as follows:</ns0:Preamble>

<ns0:Num>SECTION 1.</ns0:Num>

(a)
<html:span class="EnSpace"/>
The Legislature finds and declares all of the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Aquatic invasive species, including the golden mussel, threaten the ecological health, recreational value, and operational integrity of California’s lakes, rivers, reservoirs, and water conveyance facilities.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Efforts to control or prevent the spread of the golden mussel and other aquatic invasive species result in extensive operational and economic impacts to water delivery and hydropower, and have increasingly limited public access to recreational opportunities such as boating, fishing, and other water-dependent activities.
</html:p>

<html:span class="EnSpace"/>
The increasing costs of mandatory decontamination, quarantine requirements, and aquatic invasive species fees are disproportionately paid for by the recreational boating community, which cannot bear alone the financial responsibility of managing this statewide threat.
</html:p>
<html:p>
(4)
<html:span class="EnSpace"/>
The Harbors and Watercraft Revolving Fund, established in Section 85 of the Harbors and Navigation Code, is structurally imbalanced and remains in deficit, thereby requiring the identification and adoption of alternative and sustainable funding sources to support statewide aquatic invasive species prevention and mitigation programs.

Establishing uniform statewide standards for vessel decontamination, including standards applicable to both motorized and nonmotorized paddlecraft, along with a system of information sharing and reciprocity among waterbodies, will improve efficiency, protect
natural resources, and support California’s economic and recreational interests.
</html:p>

(b)
<html:span class="EnSpace"/>
It is the intent of the Legislature to enact subsequent legislation that would accomplish all of the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Address and prevent the spread of aquatic invasive species, including, but not limited to, the golden mussel, which currently represents an urgent and significant threat to the state’s water resources, in California’s waterbodies and water infrastructure systems.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Establish a statewide standard for the decontamination of all waterborne vessels and equipment, including motorized vessels, paddlecraft, and other potential vectors capable of transmitting aquatic invasive species, including the golden mussel.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Create a statewide database to voluntarily
track the movement of vessels, equipment, and other vectors among California waterbodies, providing waterbody managers with accurate information on the prior contamination status of these vessels.
</html:p>
<html:p>
(4)
<html:span class="EnSpace"/>
Develop a system of reciprocity that recognizes and honors certifications of decontamination for vessels and equipment moving between noninfested waterbodies, thereby facilitating safe recreational access.
</html:p>
<html:p>
(5)
<html:span class="EnSpace"/>
Identify and implement, to the extent feasible, alternative and equitable funding sources beyond fees imposed on the recreational boating community, such as assessments on commercial activities, including on international cargo shipping operations that may impact the introduction of aquatic invasive species to California waters.
