<html:p>Under existing law, the Legislature finds and declares that the agricultural and seafood industries are vitally important elements of the state’s economy. Existing law provides for various commissions and councils to promote the marketing and production of agricultural or seafood commodities, including the California Navel Orange Commission.</html:p>
<html:p>This bill would repeal the provisions providing for the creation of the California Navel Orange Commission.</html:p>
<html:p>This bill would create the California Citrus Commission in the state government with a prescribed membership, and would specify the powers, duties, and responsibilities of the commission’s board of directors. The bill would authorize the commission’s board of directors to, among other things, conduct activities in furtherance of the California citrus industry,
including education, promotion, and marketing, conduct any activities necessary to prevent the introduction of, and to eradicate, any and all citrus pests and diseases, and recommend to the Secretary of Food and Agriculture citrus grades, quality, and labeling standards. The bill would authorize the commission to levy an annual assessment on producers, as defined, and would authorize the commission to expend revenues from those assessments and all other moneys received by the commission, including from penalties for failing to pay the assessment and the civil penalties described below, for purposes of implementing the bill, thereby making an appropriation.</html:p>
<html:p>The bill would provide that the commission would not be established, and these provisions would not be implemented, except as necessary to conduct an election, until the producers of citrus vote in favor of establishing the commission, as prescribed. The bill would also provide for the suspension of the operation
of the commission and for concluding the operation of the commission under certain circumstances. The bill would authorize the commission to levy a civil penalty, as specified, on a person for willfully rendering or furnishing false reports, secreting, destroying, or altering records, or failing or refusing to furnish to the commission information concerning the name and address of persons from whom citrus is received and the quantity received. The bill would authorize the commission to bring certain civil actions to enforce the bill’s provisions.</html:p>
<html:p>Existing law creates the California Citrus Pest and Disease Prevention Committee in the Department of Food and Agriculture to, among other things, develop a statewide citrus specific pest and disease work plan. Existing law provides for a monthly assessment to be paid by producers, as defined, which are deposited into the Citrus Disease Management Account in the Department of Food and Agriculture Fund. Moneys in the Citrus
Disease Management Account are available upon appropriation by the Legislature for specified activities relating to citrus disease prevention.</html:p>
<html:p>This bill would suspend the requirement to pay the monthly assessment if the commission is established, as specified. The bill would also authorize the commission board of directors, if it is established, and contingent upon concurrence by the secretary, to assume the powers and duties of the committee pursuant to an agreement with that committee.</html:p>
<html:p>Existing constitutional provisions require that a statute that limits the right of access to the meetings of public bodies or the writings of public officials and agencies be adopted with findings demonstrating the interest protected by the limitation and the need for protecting that interest.</html:p>
<html:p>This bill would make legislative findings to that effect.</html:p>

(a)

During the first marketing season, beginning February 1, 2010, and ending September 30, 2010, the monthly assessment to be paid by producers shall be one cent ($0.01) per carton. Thereafter, in addition to any other assessments, fees, or charges that may be required pursuant to this code, producers shall pay a monthly assessment established by the committee that shall not exceed twelve cents ($0.12) per carton. The assessment shall be:

Based on the number of 40-pound carton equivalents produced.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Collected from the producer by the first handler. If a producer prepares the citrus fruit for market, the producer shall be deemed the handler.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Remitted to the department by the first handler, along with an assessment report, at the end of each month during the marketing season.
</html:p>
<html:p>
(4)
<html:span class="EnSpace"/>
Deposited into the Citrus Disease Management Account in the Department of Food and Agriculture Fund or, upon the recommendation of the committee, deposited in accordance with Section 227 or Article 2.5 (commencing with Section 230) of Chapter 2 of Part 1 of Division 1. The use of the funds deposited into the Citrus Disease Management Account shall be limited to the activities authorized by this article.

(b)

A producer producing less than 750 40-pound carton equivalents shall not be required to remit the assessment provided in subdivision (a).
</html:p>

(c)
<html:span class="EnSpace"/>
The committee may recommend to the secretary an assessment less than the amount specified in subdivision (a) or no assessment if no disease prevention program is necessary or if there is sufficient reserve to operate the program, except as provided in Section 5930.

Upon the establishment of the California Citrus Commission pursuant to Article 5 (commencing with Section 73201) of Chapter 11 of Part 2 of Division 22 and establishment of the initial assessment for that commission pursuant to Article 6 (commencing with Section 73251) of that chapter, the requirement to
pay the monthly assessment required by this section is suspended.

If the monthly assessment required by this section is suspended pursuant to paragraph (1), the requirement to pay that monthly assessment shall resume if the commission described in paragraph (1) is suspended pursuant to Article 8 (commencing with Section 73351) of Chapter 11 of Part 2 of Division 22.

<html:p>The continued strength and growth of the citrus industry depend on the protection and preservation of healthy citrus fruit throughout the state. The threat posed by citrus pests and diseases, such as Huanglongbing and Asian citrus psyllid, endangers not only existing groves but also the industry’s ability to sustain domestic and international markets. Effective surveying, trapping, and treatment managed through the California Citrus Commission is essential to prevent the introduction and spread of destructive pests and diseases. Success relies on coordinated efforts to monitor and manage infestations, ensuring the long-term vitality, productivity, and reputation of California citrus. To achieve that most efficiently, the California Citrus Commission can better coordinate state and grower
activities.</html:p>

“Districts” mean the following:

District 1 shall comprise that part of the state west of a line drawn due north and south through White Water and north of a line drawn due east and west through Gorman, but excluding the Counties of San Luis Obispo and Santa Barbara.

(2)
<html:span class="EnSpace"/>
District 2 shall comprise that part of the state west of a line drawn due north and south through White Water and south of a line drawn due east and west through Gorman, but including the Counties of San Luis Obispo and Santa Barbara.
</html:p>

(3)
<html:span class="EnSpace"/>
District 3 shall comprise the remainder of the state not included in District 1 or District 2.
</html:p>

(b)
<html:span class="EnSpace"/>
The boundaries of any district may be changed by a two-thirds vote of the commission, which is concurred in by the secretary, to maintain similar total production among the districts and to ensure proper representation by producers. The boundaries are not required to coincide with county lines.

<html:p>“Handler” means a person who engages in the operation of selling or marketing citrus that the person has produced, purchased, or acquired from a producer, or that the person is marketing on behalf of a producer, whether as owner, agent, employee, or broker or otherwise. “Handler” does not include a retailer, except a retailer who purchases or acquires from, or handles on behalf of, a producer citrus that were not previously subject to regulation by the commission.</html:p>

There is in state government the California Citrus Commission. Except as provided in subdivision (c), the commission board of directors shall be composed of 20 producers and one public member.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
The commission board of directors shall consist of the following members:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Fifteen producers shall be nominated and elected from District 1.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Three producers shall be nominated and elected from District 2.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Two producers shall be nominated and elected from District 3.
</html:p>
<html:p>
(4)
<html:span class="EnSpace"/>
One
public member shall be appointed pursuant to Section 73102.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
The commission board of directors may modify the number of members who serve on the commission board of directors by a two-thirds vote that is concurred in by the secretary, if proper notice is provided to all persons subject to this chapter before the action. In doing so, the commission board of directors may consider factors, including, but not limited to, changes in acreage and tonnage of districts.

The secretary may require the commission to correct or cease any existing activity or function that is determined by the secretary not to be in the public interest or that is in violation of this chapter.

If the commission refuses or fails to cease the activities or functions or to make the corrections as required by the secretary, the secretary may, upon written notice, suspend all or a portion of the activities or functions of the commission until the time that the cessation or correction of activities or functions required by the secretary has been accomplished by the commission.

Actions of the commission in violation of a written notice have no legal force or effect. The secretary, to the extent feasible, shall issue the written notice before the commission enters into any contractual relationship affecting the existing or proposed activities or functions that are the subject of the written notice.

<html:p>
(b)
<html:span class="EnSpace"/>
Upon service of the written notice, the secretary shall notify the commission, in writing, of the specific acts that the secretary determines are not in the public interest or are in violation of this chapter and the reasons for requiring a cessation or correction of specific existing or proposed activities or functions, and the secretary may make recommendations that will make the activities or functions
acceptable.

<html:p>The commission may bring an action for judicial relief from the secretary’s written notice, and the secretary may bring an action for judicial relief from noncompliance by the commission with the written notice, in a court of competent jurisdiction, which may issue a temporary restraining order, permanent injunction, or other applicable relief.</html:p>

<html:p>The commission shall reimburse the secretary for all expenditures incurred by the secretary in carrying out their duties and responsibilities under this chapter. However, the court may, if it finds that the secretary acted arbitrarily or capriciously in restricting the activities or functions of the commission, relieve the commission of the responsibility for payment of the secretary’s legal costs with regard to the action.</html:p>

Any vacancy on the commission occurring by the failure of any elected member to continue in their position due to a change in status making the member ineligible to serve, or due to death, removal, resignation, or disqualification, shall be filled for the unexpired portion of the term by appointment by a majority vote of the commission.
</html:p>

(b)
<html:span class="EnSpace"/>
A person appointed pursuant to subdivision (a) shall fulfill all the requirements set forth in this article for the member whose office they are to fill.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
The qualification of any person to fill a vacancy on the commission shall be certified by the commission, in writing, to the secretary. The secretary shall notify the commission if
the secretary determines that the person is not qualified.

With respect to the first elected members, seven of the producers shall serve for one year, seven of the producers shall serve for two years, and six of the producers shall serve for three years, with the determination of the term of each member to be made by lot.

The commission may sue and be sued, may contract and be contracted with, and has all of the powers of a corporation. It may adopt a corporate seal.

<html:p>
(c)
<html:span class="EnSpace"/>
Copies of its proceedings, records, and acts, when authenticated, shall be admissible in evidence in all courts of the state and shall be prima facie evidence of the truth of all statements in those copies.
</html:p>

However, the secretary or their representatives, or any other ex officio member, is not entitled to attend an executive session of the commission called for the purpose of discussing potential or actual litigation involving either the department or the organization represented by the ex officio member, as applicable.</html:p>

A member of the commission or a member of a committee established by the commission who is a nonmember of the commission shall not receive a salary.

Except for ex officio government members, each member may receive reasonable and necessary traveling expenses and meal allowances, as established by the commission board of directors, for each day spent in actual attendance at, or in traveling to and from, meetings of the commission or committees of the commission, or on special assignment for the commission.

All funds received by a person from the assessments levied under the authority of this chapter, or otherwise received by the commission, shall be deposited into the banks or other appropriate financial institutions designated by the commission and shall be disbursed by order of the commission through the agent or agents that it designated for that purpose.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
The agent or agents shall be bonded by a fidelity bond, executed by a surety company authorized to transact business in this state, in favor of the commission, in the amount of not less than twenty-five thousand dollars ($25,000).

<html:p>The state shall not be liable for the acts of the commission or its contracts. Payments of all claims arising by reason of the administration of this chapter or acts of the commission shall be limited to the funds collected by the commission. Members of the commission board of directors, employees, and agents of the commission shall not be personally liable for the contracts of the commission, and members of the commission board of directors and employees of the commission shall not be responsible individually in any way to a grower, handler, or any other person for error in judgment, mistakes, or other acts, either of commission or omission, as principal, agent, or employee, except for their own individual acts of dishonesty or crime. Members of the commission board of directors shall not be held responsible individually for
any act or omission of any other member. The liability of the members of the commission board of directors shall be several and not joint, and a member shall not be liable for the default of any other member.</html:p>

<html:p>The powers and duties of the commission board of directors shall include, but are not limited to, all of the following:</html:p>
<html:p>
(a)
<html:span class="EnSpace"/>
Adopt and, from time to time, alter, rescind, modify, and amend in a manner prescribed by the commission, all proper and necessary bylaws, rules and regulations, and orders for carrying out this chapter, including rules for appeals from any bylaw, rule and regulation, or order of the commission. These actions shall not be subject to Chapter 3.5 (commencing with Section 11340) of Part 1 of Division 3 of Title 2 of the Government Code.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
Administer and enforce this chapter and perform all acts and exercise all powers incidental to, or in connection with, or deemed reasonably
necessary for, the proper or advisable effectuation of the purposes of this chapter.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
Appoint officers from the members of the commission board of directors, including a chairperson, one or more vice chairpersons, and other officers that it deems necessary. The officers shall have the powers and duties delegated to them by the commission.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
Employ a person to serve at the pleasure of the commission as president and chief executive officer, and other personnel, including legal counsel, necessary to carry out this chapter. Alternatively, the commission may retain a management firm or staff from any board, commission, or committee of the state to perform the functions prescribed by this subdivision under control of the commission board of directors. If a person subject to this subdivision engages in conduct that the secretary determines to be in violation of this chapter, or is
not in the public interest, the secretary shall notify the commission of the conduct and request that corrective, and if appropriate, disciplinary action, be taken by the commission board of directors. If the commission board of directors fails or refuses to correct the situation or to take disciplinary action satisfactory to the secretary, the secretary may suspend or discharge the person subject to this subdivision.
</html:p>
<html:p>
(e)
<html:span class="EnSpace"/>
Fix the compensation for all employees of the commission.
</html:p>
<html:p>
(f)
<html:span class="EnSpace"/>
Appoint committees that may be composed of both members and nonmembers of the commission to advise the commission board of directors in carrying out this chapter.
</html:p>
<html:p>
(g)
<html:span class="EnSpace"/>
Establish offices and incur expenses, enter into any and all contracts and agreements, create liabilities, and borrow funds in advance of receipt of assessments for that
year, that may be necessary, in the opinion of the commission, for the proper administration and enforcement of this chapter and the performance of its duties.
</html:p>
<html:p>
(h)
<html:span class="EnSpace"/>
Keep accurate books, records, and accounts of all of its dealings, which shall be subject to an annual audit by an auditing firm selected by the commission with the concurrence of the secretary. The audit shall be made a part of an annual report to all producers, and, notwithstanding Sections 9795 and 10231.5 of the Government Code, copies of which shall also be submitted to the Legislature and the department. In addition, the secretary may, as they determine it to be necessary, conduct or cause to be conducted a fiscal and compliance audit of the commission.
</html:p>
<html:p>
(i)
<html:span class="EnSpace"/>
Present facts to, and negotiate with, state, federal, and foreign agencies on matters that affect the purposes of this chapter.
</html:p>
<html:p>
(j)
<html:span class="EnSpace"/>
Make, in the name of the commission, contracts to render service in formulating and conducting plans and programs, and any other contracts or agreements determined to be necessary for the purposes of this chapter.
</html:p>
<html:p>
(k)
<html:span class="EnSpace"/>
Accept contributions of, or match, private, state, or federal funds that may be available, and employ or make contributions of funds to other persons or state or federal agencies in furtherance of the purposes of this chapter.
</html:p>
<html:p>
(l)
<html:span class="EnSpace"/>
Collect information and publish and distribute to growers a bulletin or other communication to disseminate information relating to this chapter.
</html:p>
<html:p>
(m)
<html:span class="EnSpace"/>
Establish an assessment rate to defray operating costs.
</html:p>
<html:p>
(n)
<html:span class="EnSpace"/>
Establish an annual budget according to
accepted accounting practices. The budget shall be concurred in by the secretary before the disbursement of funds, except for disbursements made pursuant to subdivision (e).
</html:p>
<html:p>
(o)
<html:span class="EnSpace"/>
Submit to the secretary for their concurrence, an annual statement of contemplated activities authorized under this chapter.
</html:p>
<html:p>
(p)
<html:span class="EnSpace"/>
Investigate and prosecute civil violations of this chapter and file complaints with appropriate law enforcement agencies or officers for suspected criminal violations of this chapter.
</html:p>
<html:p>
(q)
<html:span class="EnSpace"/>
Prescribe the form and manner by which proponents and opponents of the commission may contact growers if all expenses associated with the contacts are paid in advance.
</html:p>
<html:p>
(r)
<html:span class="EnSpace"/>
Engage in communications with the public regarding activities authorized in this section.
</html:p>
<html:p>
(s)
<html:span class="EnSpace"/>
Conduct activities in furtherance of the California citrus industry in accordance with this chapter, including, but not limited to, education, promotion, and marketing.
</html:p>
<html:p>
(t)
<html:span class="EnSpace"/>
Conduct any activities necessary to prevent the introduction of, and to eradicate, any and all citrus pests and diseases, including, but not limited to, the development of a statewide work plan. The commission shall not engage in any activity deemed by the secretary to be contradictory to any eradication program or quarantine implemented to combat citrus specific pests, diseases, or related vectors.
</html:p>
<html:p>
(u)
<html:span class="EnSpace"/>
Perform any and all acts necessary or proper to fully and completely carry out the purposes of this chapter.
</html:p>
<html:p>
(v)
<html:span class="EnSpace"/>
Assume the duties and powers provided to the Citrus Pest Disease
Prevention Committee specified in Article 2 (commencing with Section 5911) of Chapter 9 of Part 1 of Division 4 pursuant to an agreement with that committee and contingent upon concurrence by the secretary.
</html:p>

(a)
<html:span class="EnSpace"/>
As soon as possible and on or before March 1, 2027, the secretary shall establish a list of producers eligible to vote on implementation of this chapter. In establishing this list, the secretary may require each handler, with respect to those producers whose citrus the handler markets, and each county agricultural commissioner, with respect to the producer with bearing acreage within the county, to submit the name and mailing address of, and the volume, if known, shipped by, each producer. The request for this information shall be in writing. The information required by the secretary shall be filed within 10 days following receipt of the written notice.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
A producer, whose name does not appear upon the secretary’s list of producers
affected, may have their name included on the list by filing with the secretary a signed statement identifying themselves as a producer. Failure to be on this list does not exempt the producer from paying assessments under this chapter.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
Additionally, the secretary may use other sources of information necessary to secure that information to establish the list.
</html:p>

<html:p>This chapter, except as necessary to conduct an implementation referendum, shall not be implemented until the secretary finds in a referendum conducted by the secretary, or a person designated by the secretary, that at least 40 percent of the total number of producers from the list established by the secretary pursuant to Section 73201, participated, and that the secretary finds either of the following occurred:</html:p>

(a)
<html:span class="EnSpace"/>
Sixty-five percent or more of the producers who voted in the referendum voted in favor of this chapter, and the producers so voting marketed a majority of the volume of citrus in the preceding fiscal year by all of the producers who voted in the referendum.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
A majority of the producers
who voted in the referendum voted in favor of this chapter, and the producers so voting marketed 65 percent or more of the volume of citrus in the fiscal year by all of the producers who voted in the referendum.
</html:p>

Subsequent to the first election of members of the commission board of directors, producers shall be selected pursuant to nomination and election procedures established by the commission board of directors with the concurrence of the secretary.

A producer with citrus acreage in more than one district shall vote only in the district in which they have the majority of their bearing acreage.

The assessment on citrus shall not exceed twelve cents ($0.12) per carton and shall be paid on a monthly basis.

Subject to paragraph (3), an assessment greater than the amount described in paragraph (1) shall not be charged unless it is approved in accordance with the voting requirements provided in Section 73202.

The assessment shall not exceed the reasonable costs
of achieving the purposes of this chapter.

Upon the establishment of the commission pursuant to Article 5 (commencing with Section 73201) and establishment of the initial assessment pursuant to this article, the requirement to pay the monthly assessment required by Section 5919 is suspended pursuant to that section.

Citrus produced on any producer’s parcel, tract, or lot of land with less than 25 citrus trees of any age growing on it, including a parcel, tract, or lot that is used as a nursery.

Notwithstanding subdivision (a), production of citrus is not exempt from the assessment under this article if it is
marketed, except as provided in Section 73251.

(b)
<html:span class="EnSpace"/>
In addition to any other penalty imposed, the commission may require a person who fails to pay an assessment or related charge pursuant to Article 6 (commencing with Section 73251) to furnish and maintain a surety bond in a form and amount and for a period of time specified by the commission as assurance that all payments to the commission will be made when due.

When engaged in the shipping of citrus fruit or in the wholesale or retail trade of citrus fruit, fails or refuses to furnish to the commission or its duly authorized agents, upon request, information concerning the name and address of the persons from whom citrus fruit was received and the quantity received.

(c)
<html:span class="EnSpace"/>
Secretes, destroys, or alters records
required to be kept under this chapter.
</html:p>

Appeals from decisions of the commission or a committee of the commission may be made to the secretary. The determination of the secretary is subject to judicial review upon petition filed with the appropriate superior court.
</html:p>

The commission may commence civil actions and use all remedies provided in law or equity for the collection of assessments and civil penalties, and for the obtaining of injunctive relief or specific performance, with respect to this chapter and the rules and regulations adopted under this chapter.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
A court shall issue to the commission any requested writ of attachment or injunctive relief upon a prima facie showing by verified complaint that a named defendant has violated this chapter or any other rule or regulation of the commission, including, but not limited to, the nonpayment of an assessment. A bond shall not be required to be posted by the commission as a condition for the issuance of any writ of attachment or injunctive
relief.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
A writ of attachment shall be issued pursuant to Chapter 5 (commencing with Section 485.010) of Title 6.5 of Part 2 of the Code of Civil Procedure, except that the showing specified in Section 485.010 is not required. Injunctive relief shall be issued pursuant to Chapter 3 (commencing with Section 525) of Title 7 of Part 2 of the Code of Civil Procedure, except that the showing of irreparable harm or of inadequate remedy at law specified by Section 526 or 527 is not required.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
Upon entry of any final judgment on behalf of the commission against any defendant, the court shall enjoin the defendant from conducting any type of business regarding the production of citrus or handling of citrus until there is full compliance with, and satisfaction of, the judgment.
</html:p>
<html:p>
(e)
<html:span class="EnSpace"/>
Upon a favorable judgment for the
commission, it shall be entitled to receive reimbursement for any reasonable attorney’s fees and other actual related costs.
</html:p>
<html:p>
(f)
<html:span class="EnSpace"/>
Venue for these actions may be established at the domicile or place of business of the defendant or in the county of the principal office of the commission. The commission may be sued only in the county of its principal office.
</html:p>

Five years after implementation of this chapter, the secretary shall hold a public hearing, after providing proper notice to persons subject to this chapter and any other persons or entities who have requested, in writing, notice of the hearing, to determine whether the implementation of this chapter should be continued. If the secretary finds after the hearing that a substantial question exists among the producers assessed under this chapter regarding whether the implementation of this chapter should be continued, the secretary shall submit the chapter to a reapproval referendum to be conducted among producers to determine whether the implementation of this chapter shall be reapproved and continued in effect.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
If the secretary finds
after conducting a hearing that no substantial question exists or, if a reapproval referendum is required, that a majority of the eligible producers voting in the referendum voted in favor of continuing the implementation of this chapter, the secretary shall certify the vote and this chapter shall continue to be implemented. If the secretary finds that a favorable vote has not been given, the secretary shall certify the vote and declare the implementation of this chapter suspended upon the expiration of the current marketing season. Thereupon, the operations of the commission shall be concluded and funds shall be distributed in the manner provided in Section 73355. A bond or security shall not be required for the referendum.

In that case, the referendum shall be every fifth year following the industry petitioned referendum.</html:p>

Upon a finding by a two-thirds vote of the commission board of directors that the implementation of this chapter has not tended to effectuate its declared purposes, the commission may recommend to the secretary that the operation of the commission be suspended. Any suspension shall not become effective until the expiration of the current marketing season.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
The secretary shall, upon receipt of this recommendation, or may, after a public hearing to review a petition filed with them requesting the suspension, signed by 15 percent of the producers by number who produced not less than 15 percent of the volume in the immediately preceding marketing season, conduct a referendum among the producers to determine if the operation of the
commission shall be suspended.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
The secretary shall establish a referendum period, which shall not be less than 10 or more than 60 days in duration. The secretary may prescribe additional procedures as may be necessary to conduct the referendum. At the close of the established referendum period, the secretary shall tabulate the ballots filed during the period.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
If at least 40 percent of the total number of producers from the list established by the secretary participated in the referendum, the secretary shall continue the implementation of this chapter, if they find either of the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Sixty-five percent or more of the producers who voted in the referendum voted in favor of continuation, and the producers who voted marketed a majority or more of the volume of citrus marketed in the preceding marketing
season by all of the producers who voted in the referendum.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
A majority of the producers who voted in the referendum voted in favor of continuation, and the producers who voted marketed 65 percent or more of the volume of citrus marketed in the preceding season by all of the producers who voted in the referendum.

After the effective date of suspension of the implementation of this chapter and of the commission, the operations of the commission shall be concluded and any and all remaining funds held by the commission, collected by assessment and not required to defray the expenses of concluding and terminating the operations of the commission, shall be returned upon a pro rata basis to all persons from whom assessments were collected in the immediately preceding marketing season.

However, if the commission finds that the amounts so returnable are so small as to make impractical the computation and remitting of a pro rata refund to these persons, any such funds remaining and any funds remaining after payment of all expenses of winding up and
terminating operations shall be withdrawn from the approved depository and paid into an appropriate state or federal program used to fund activities related to the subject matter of this chapter. If no such program exists, the funds shall be paid into the State Treasury as unclaimed trust money.

<ns0:Num>SEC. 5.</ns0:Num>

<html:p>The Legislature finds and declares that Section 3 of this act, which adds Chapter 11 (commencing with Section 73001) to Part 2 of Division 22 of the Food and Agricultural Code, imposes a limitation on the public’s right of access to the meetings of public bodies or the writings of public officials and agencies within the meaning of Section 3 of Article I of the California Constitution. Pursuant to that constitutional provision, the Legislature makes the following findings to demonstrate the interest protected by this limitation and the need for protecting that interest:</html:p>
<html:p>In order to protect confidential and proprietary information provided to the California Citrus Commission by growers and handlers, the limitations on the public’s right of access
imposed by Section 3 of this act are necessary.</html:p>
