                <ns0:Title> An act to amend Sections 12286, 12302, 12303, 12307, 12309, 12318, 12327, 17502, and 17503 of, to repeal Sections 12306 and 12316 of, and to repeal and add Sections 12300 and 12301 of, the Elections Code, relating to elections. </ns0:Title>

                        <html:p>Existing law requires a county elections official to divide each jurisdiction within the county into precincts and to appoint a precinct board for each precinct at least 29 days before an election within the jurisdiction. Any voter may apply to the county elections official to serve as a precinct board member.</html:p>
                        <html:p>This bill would instead require precinct board members to be randomly selected by the elections official. The Department of Motor Vehicles would be required to furnish each elections official with the current list of the names, addresses, and other identifying information of persons residing in the county who are 18 years of age or older and hold a current driver’s license or identification card. The bill would make every voter in the jurisdiction eligible to be selected, with specified exceptions.</html:p>
                        <html:p>A person who is selected to serve as a precinct board member would be authorized to apply to the county elections official to be excused from service as a precinct board member for undue hardship upon themselves or the public. A person excused for undue hardship would be automatically selected to serve as a precinct board member in the following election. The bill would also authorize a person who is 70 years of age or older to choose to be excused. The bill would make other conforming changes to the process for selecting precinct board members.</html:p>
                        <html:p>By increasing the duties of local elections officials with respect to conducting elections, the bill would impose a state-mandated local program.</html:p>
                        <html:p>The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for
                making that reimbursement.</html:p>
                        <html:p>This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.</html:p>

                                                                At least 29 days prior to the election, the elections official shall do all of the following:
                                                        </html:p>
                                                        <html:p>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                Establish a convenient number of election precincts within the affected jurisdiction.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                Define the precinct boundaries.
                                                        </html:p>
                                                        <html:p>
                                                                (3)
                                                                <html:span class="EnSpace"/>
                                                                Designate a polling place for each precinct.
                                                        </html:p>
                                                        <html:p>
                                                                (4)
                                                                <html:span class="EnSpace"/>
                                                                Select precinct board members pursuant to Chapter 4 (commencing with Section 12300) and assign precinct board members to each precinct.
                                                        </html:p>
                                                        <html:p>
                                                                (5)
                                                                <html:span class="EnSpace"/>
                                                                Notify the members of each precinct board of their assignment and the location of the precinct and polling place where they will serve.
                                                        </html:p>

                                                                (b)
                                                                <html:span class="EnSpace"/>
                                                                The elections official, in establishing precincts and defining their boundaries, shall, to the extent practicable, provide for a single polling place where a voter entitled to vote in more than one district may cast all of his or her ballots.
                                                        </html:p>

                                                                (c)
                                                                <html:span class="EnSpace"/>
                                                                In a
                                  landowner voting district, the county elections official shall designate the polling place at which a nonresident landowner shall vote.
                                                        </html:p>

                                                                (d)

                                                                This section does not apply to elections conducted using vote centers.

                                                                For each election, the elections official shall randomly select individuals from the eligible persons described in Section 12301 to serve as precinct board members.
                                                        </html:p>

                                                                (b)
                                                                <html:span class="EnSpace"/>
                                                                The Department of Motor Vehicles shall furnish each elections official with the current list of the names, addresses, and other identifying information of persons residing in the county who are age 18 years or older and who are holders of a current driver’s license or identification card issued pursuant to Article 3 (commencing with Section 12800) of, or Article 5 (commencing with Section 13000) of, Chapter 1 of Division 6 of the Vehicle Code. This service shall be provided by the Department of Motor Vehicles consistent with Section 1812 of the Vehicle Code. The elections
                                  official shall not disclose the information furnished by the Department of Motor Vehicles pursuant to this section to any person, organization, or agency.

                                                                <html:span class="EnSpace"/>
                                                                The elections official shall assign the individuals selected pursuant to subdivision (a) to precincts within the jurisdiction in which the election will occur. The individuals selected shall constitute the precinct board for that precinct.

                                                                Every person is eligible and qualified to serve as a precinct board member, except the following:
                                                        </html:p>
                                                        <html:p>
                                                                (A)
                                                                <html:span class="EnSpace"/>
                                                                Persons who are not citizens of the United States, except as provided in Section 12302.
                                                        </html:p>
                                                        <html:p>
                                                                (B)
                                                                <html:span class="EnSpace"/>
                                                                Persons who are less than 18 years of age, except as provided in Section 12302.
                                                        </html:p>
                                                        <html:p>
                                                                (C)
                                                                <html:span class="EnSpace"/>
                                                                Persons whose domicile is not within the State of California, as determined pursuant to Article 2 (commencing with Section 2020) of Chapter 1 of Division 2.

                                                                (D)
                                                                <html:span class="EnSpace"/>
                                                                Persons who are not residents of the county in which they are selected to serve.

                                                                Persons who have been convicted of malfeasance in office and whose civil rights have not been restored.

                                                                Persons who cannot read or write in the English language, provided that no person shall be deemed incompetent solely because of the loss of sight or hearing in any degree or other disability which impedes the person’s ability to communicate or which impairs or interferes with the person’s mobility.
                                                        </html:p>

                                                                (G)
                                                                <html:span class="EnSpace"/>
                                                                Persons who are serving as grand or trial jurors in any court of this state.
                                                        </html:p>
                                                        <html:p>
                                                                (H)
                                                                <html:span class="EnSpace"/>
                                                                Persons who are the subject of conservatorship.
                                                        </html:p>
                                                        <html:p>
                                                                (I)
                                                                <html:span class="EnSpace"/>
                                                                Persons while they are incarcerated in any prison or jail.
                                                        </html:p>
                                                        <html:p>
                                                                (J)
                                                                <html:span class="EnSpace"/>
                                                                Persons who have been
                                  convicted of a felony and are currently on parole, postrelease community supervision, felony probation, or mandated supervision for the conviction of a felony.
                                                        </html:p>
                                                        <html:p>
                                                                (K)
                                                                <html:span class="EnSpace"/>
                                                                Persons who are currently required to register as a sex offender pursuant to Section 290 of the Penal Code based on a felony conviction.
                                                        </html:p>
                                                        <html:p>
                                                                (L)
                                                                <html:span class="EnSpace"/>
                                                                Persons who are candidates for elective office in the election for which precinct board members are being selected, or persons holding elective office.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                A person shall not be excluded from eligibility for jury service in the State of California for any reason other than those reasons provided by this section.
                                                        </html:p>
                                                        <html:p>
                                                                (3)
                                                                <html:span class="EnSpace"/>
                                                                An eligible person shall not be exempt from service as a precinct board member by reason of occupation, economic status, any characteristic
                                  identified in Section 11135 of the Government Code, or for any other reason.
                                                        </html:p>
                                                        <html:p>
                                                                (b)
                                                                <html:span class="EnSpace"/>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                (A)
                                                                <html:span class="EnSpace"/>
                                                                Except as provided in paragraph (3), an eligible person may be excused from service as a precinct board member only for undue hardship upon themselves or the public.
                                                        </html:p>
                                                        <html:p>
                                                                (B)
                                                                <html:span class="EnSpace"/>
                                                                A person selected to serve as a precinct board member may apply to the elections official to be excused for undue hardship.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                Notwithstanding Section 12300, a person who is excused from serving as a precinct board member for an election because of undue hardship shall be automatically selected to serve as a precinct board member in the following election held in the jurisdiction, provided the person remains eligible and qualified to serve as a precinct board member in that jurisdiction.
                                                        </html:p>
                                                        <html:p>
                                                                (3)
                                                                <html:span class="EnSpace"/>
                                                                An eligible person who is 70 years of age or older may choose to be excused from service as a precinct board member.
                                                        </html:p>
                                                        <html:p>
                                                                (c)
                                                                <html:span class="EnSpace"/>
                                                                The provisions of this section are severable. If any provision of this section or its application is held invalid, that invalidity shall not affect other provisions or applications that can be given effect without the invalid provision or application.

                                                                Except as provided in subdivisions (b) and (c), a member of a precinct board shall be a voter of the state.
                                                        </html:p>
                                                        <html:p>
                                                                (b)
                                                                <html:span class="EnSpace"/>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                In order to provide for a greater awareness of the elections process, the rights and responsibilities of voters, and the importance of participating in the electoral process, as well as to provide additional members of precinct boards, an elections official may appoint not more than five pupils per precinct to serve under the direct supervision of precinct board members designated by the elections official. A pupil may be appointed, notwithstanding his or
                                  her lack of eligibility to vote, subject to the approval of the governing board of the educational institution in which the pupil is enrolled, if the pupil possesses the following qualifications:
                                                        </html:p>
                                                        <html:p>
                                                                (A)
                                                                <html:span class="EnSpace"/>
                                                                Is at least 16 years of age at the time of the election for which he or she is serving as a member of a precinct board.
                                                        </html:p>
                                                        <html:p>
                                                                (B)
                                                                <html:span class="EnSpace"/>
                                                                Is a United States citizen, will be a citizen at the time of the election for which he or she is serving as a member of a precinct board, or is lawfully admitted for permanent residence in the United States, as defined in Section 101(a)(20) of the federal Immigration and Nationality Act (8 U.S.C. Sec. 1101(a)(20)).
                                                        </html:p>
                                                        <html:p>
                                                                (C)
                                                                <html:span class="EnSpace"/>
                                                                Is a pupil in good standing attending a public or private secondary educational institution.
                                                        </html:p>
                                                        <html:p>
                                                                (D)
                                                                <html:span class="EnSpace"/>
                                                                Is a pupil who has a
                                  grade point average of at least 2.5 on a 4.0 scale.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                A pupil appointed pursuant to this subdivision shall not be used by a precinct board to tally votes.
                                                        </html:p>
                                                        <html:p>
                                                                (c)
                                                                <html:span class="EnSpace"/>
                                                                (1)
                                                                <html:span class="EnSpace"/>
                                                                In order to promote civic engagement among residents of the state and to provide additional members of precinct boards, an elections official may appoint not more than five nonvoters per precinct to serve as precinct board members. A nonvoter may be appointed, notwithstanding his or her lack of eligibility to vote, if the nonvoter possesses the following qualifications:
                                                        </html:p>
                                                        <html:p>
                                                                (A)
                                                                <html:span class="EnSpace"/>
                                                                Is lawfully admitted for permanent residence in the United States,
                                  as defined in Section 101(a)(20) of the federal Immigration and Nationality Act (8 U.S.C. Sec. 1101(a)(20)).
                                                        </html:p>
                                                        <html:p>
                                                                (B)
                                                                <html:span class="EnSpace"/>
                                                                Is otherwise eligible to register to vote pursuant to Section 2101 except for his or her lack of United States citizenship.
                                                        </html:p>
                                                        <html:p>
                                                                (2)
                                                                <html:span class="EnSpace"/>
                                                                Any individual who possesses the qualifications set forth in paragraph (1) may apply to the elections official for the position of precinct board member.
                                                        </html:p>
                                                        <html:p>
                                                                (3)
                                                                <html:span class="EnSpace"/>
                                                                A nonvoter appointed to a precinct board
                                  pursuant to this subdivision shall not be permitted to do either of the following:
                                                        </html:p>
                                                        <html:p>
                                                                (A)
                                                                <html:span class="EnSpace"/>
                                                                Serve as, or perform any of the duties of, the inspector of a precinct board.
                                                        </html:p>
                                                        <html:p>

                                                                Where the elections official finds that citizens described in subdivision (b) approximate 3 percent or more of the voting-age residents of a precinct, or if interested citizens or organizations provide information that the elections official believes indicates a need for voting assistance for qualified citizens described in subdivision (b), the elections official shall make reasonable efforts to assign individuals who are fluent in a language used by citizens described
