<html:p>Existing law establishes the California Community Colleges under the administration of the Board of Governors of the California Community Colleges. Existing law establishes community college districts throughout the state, and authorizes these districts to provide instruction at the community college campuses they operate and maintain. Existing law provides for a formula for the calculation of general purpose apportionments of state funds to community colleges. Existing law provides a separate formula for the allocation of apportionments of state funds to community colleges, which uses the numbers of full-time equivalent students as its basis, for use for apportionments for noncredit instruction and instruction in career development and college preparation. Existing law specific the noncredit courses, noncredit classes, and support services that are eligible for state apportionment.</html:p>
<html:p>This bill would require the board of governors to allocate base funding for designated categorical programs to noncredit colleges, as defined, and noncredit centers, as defined, that meet specified conditions. The bill would specify that the categorical programs eligible for those base funding allocations include, but are not limited to, disabled student programs and services, mental health services, and veteran resource centers. The bill would require the board of governors, in consultation with the office of the Chancellor of the California Community Colleges, to determine the methodology for allocating the base funding.</html:p>

(a)
<html:span class="EnSpace"/>
As used in this section, the following definitions apply:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
“Noncredit center” means an educational center established and administered by a community college district that only provides noncredit instruction, classes, courses, and programs under Sections 84750.5 and 84757.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
“Noncredit college” means an independently accredited institution in a community college district that only provides noncredit instruction, classes, courses, and programs under Sections 84750.5 and 84757.
</html:p>
<html:p>
(b)
<html:span class="EnSpace"/>
The board of governors shall allocate base funding for designated categorical programs to a noncredit college when the noncredit
college meets both of the following conditions:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Has a president or equivalent executive administrator reporting to a community college district chancellor, superintendent, or president, as applicable, with independent responsibility for the comprehensive operations of the community college district’s noncredit programs.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Provides basic needs programs, disabled students programs and services, or mental health programs with designated coordinators, directors, or deans.
</html:p>
<html:p>
(c)
<html:span class="EnSpace"/>
The board of governors shall allocate base funding for designated categorical programs to a noncredit center when the noncredit center meets all of the following conditions:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
The conditions described in paragraphs (1) and (2) of subdivision (b).
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
The governing board of the community college district plans to continue operating the noncredit center for at least 10 years after receiving funding under this section.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
The board of governors approves the noncredit center to receive funding pursuant to this article.
</html:p>
<html:p>
(d)
<html:span class="EnSpace"/>
The categorical programs eligible for an allocation of base funding under this section shall include, but are not limited to, all of the following:
</html:p>
<html:p>
(1)
<html:span class="EnSpace"/>
Basic needs.
</html:p>
<html:p>
(2)
<html:span class="EnSpace"/>
Disabled students programs and services.
</html:p>
<html:p>
(3)
<html:span class="EnSpace"/>
Mental health services.
</html:p>
<html:p>
(4)
<html:span class="EnSpace"/>
The Student Equity and Achievement Program
established under Article 1.5 (commencing with Section 78220) of Chapter 2 of Part 48.
</html:p>
<html:p>
(5)
<html:span class="EnSpace"/>
Veteran resource centers, including those described in Section 41207.47.
</html:p>
<html:p>
(e)
<html:span class="EnSpace"/>
The board of governors, in consultation with the office of the Chancellor of the California Community Colleges, shall determine the methodology for allocating base funding pursuant to this section.
